Section 112 The Indian Contract Act, 1872
Section 112 of the Indian Contract Act, 1872 states:
π Section 112 β Effect of Neglect of Promisee to Afford Promisor Reasonable Facilities for Performance
"If any promisee neglects or refuses to afford the promisor reasonable facilities for the performance of his promise, the promisor is excused by such neglect or refusal as to any non-performance caused thereby."
π Explanation:
When the promisee (the person to whom the promise is made) fails to give the necessary support, access, or conditions required for the promisor (the person making the promise) to fulfill their promise, the promisor is not held liable for non-performance.
π‘ Example:
A contracts with B to repair B's house. B must allow A to access the house to do the repairs. If B refuses to let A enter the house, and the repairs are not done, A cannot be blamed for not performing the contract. A is excused because B failed to provide the required access.
β Key Points:
Protects the promisor if the promisee causes the failure.
The excuse applies only to the extent of non-performance caused by the promiseeβs neglect or refusal.
Encourages cooperation between both parties in contract execution.
