Section 313 of the Companies Act, 2013

Section 313 of the Companies Act, 2013 deals with Appeals from orders of the Tribunal.

Section 313 — Appeal from orders of the Tribunal

Any person aggrieved by an order made by the National Company Law Tribunal (NCLT) under the Companies Act, 2013 may prefer an appeal to the National Company Law Appellate Tribunal (NCLAT).

The appeal must be filed within 45 days from the date of the order of the Tribunal.

The Appellate Tribunal may entertain an appeal after the expiry of the 45-day period if it is satisfied that the appellant was prevented by sufficient cause from filing the appeal in time.

This section provides a statutory right to challenge the orders passed by the NCLT before the NCLAT, thus ensuring a mechanism for review.
