Section 427 of the Companies Act, 2013

Section 427 of the Companies Act, 2013
Title: Power to Punish for Contempt

Bare Act Text:

The Tribunal and the Appellate Tribunal shall have the same powers as are vested in a civil court under the Contempt of Courts Act, 1971, while trying a case for contempt of itself.

Explanation:

Section 427 gives the National Company Law Tribunal (NCLT) and the National Company Law Appellate Tribunal (NCLAT) the authority to punish for contempt, just like a civil court.

This means if:

Someone disobeys an order,

Shows disrespect in the courtroom, or

Interferes with the judicial process,

then the Tribunal or Appellate Tribunal can take contempt proceedings against that person under the Contempt of Courts Act, 1971.
