Section 410 of the Companies Act, 2013

Section 410 of the Companies Act, 2013 deals with the Constitution of Appellate Tribunal.

⚖️ Section 410 – Constitution of Appellate Tribunal

Provision:

The section provides that:

The Central Government shall constitute, with effect from such date as may be notified, an Appellate Tribunal to be known as the National Company Law Appellate Tribunal (NCLAT) for hearing appeals against:

(a) the orders of the National Company Law Tribunal (NCLT) under this Act; and
(b) the orders passed by the Insolvency and Bankruptcy Board of India (IBBI) under Section 202 and Section 211 of the Insolvency and Bankruptcy Code, 2016.

🧑‍⚖️ Key Points:

NCLAT is the appellate body above NCLT.

Appeals against NCLT orders under the Companies Act, 2013 lie with NCLAT.

Appeals against certain orders of the IBBI under the IBC, 2016 also lie with NCLAT.

NCLAT's decisions can be appealed to the Supreme Court of India on a question of law.
