Section 284 of the Companies Act, 2013 deals with Procedure for Rectification of Name of Company.
Section 284 — Procedure for Rectification of Name of Company
If the Registrar of Companies (RoC) has reasonable cause to believe that a company's name is identical with or too nearly resembles the name of an existing company or a registered trademark, or is undesirable for any other reason, the RoC may call upon the company to change its name.
The company must comply with this direction and apply to the RoC for a new name within one month from the date of such direction.
If the company fails to do so, the RoC may initiate proceedings for removal of the company’s name from the register of companies.
The section empowers the RoC to ensure that company names are not misleading or infringe on existing trademarks or company names, maintaining clarity and preventing confusion in the market.
