Disciplinary Action Frameworks
I. What is Disciplinary Action Framework?
Set of statutory rules governing how employer can punish employee for misconduct while maintaining Natural Justice, Proportionality, Fair Play.
For banks: Two parallel frameworks:
For Award Staff (Clerks, Sub-staff): Sastri Award + Desai Award + Shastri Award + Bipartite Settlements - Clause 45 lays down provisions about disciplinary action and procedure for bank employees other than officers. Provides complete mechanism including suspension.
For Officers: Bank-specific Officer Employees' (Discipline and Appeal) Regulations, 1976 framed under Sec 19 of Bank Nationalisation Act - Specifies penalty structure, disciplinary authority, suspension power, major penalty procedure, subsistence allowance, appeal and review. Controlling framework is ordinarily these Regulations.
II. 7-Stage Process - Mandatory
Stage 1: Preliminary Fact Finding
Informal inquiry to decide if prima facie misconduct. No notice needed. Report cannot be used as evidence unless supplied - see Union of India vs T.R. Varma.
Stage 2: Suspension (Optional)
Under Regulation 12. If misconduct grave, or presence may tamper evidence. Subsistence allowance 50% for 1st year, 75% after. Must be reviewed every 90 days - Ajay Kumar Choudhary vs UoI (2015) 7 SCC 291 - Suspension cannot be indefinite.
Stage 3: Charge Sheet - Most Important
Must contain:
- Specific articles of charge with time, date, place
- List of documents
- List of witnesses
- Imputations of misconduct referencing Conduct Regulations.
Failure = violation of natural justice. But per Supreme Court 2024: Disciplinary Action Can't Be Challenged On Ground Of Non-Supply Of Particular Document Unless Grave Prejudice Shown - employee must show how non-supply prejudiced defence.
Stage 4: Inquiry - Principles of Natural Justice
A.K. Kraipak vs Union of India (1969) 2 SCC 262 - Aim of Natural Justice is to secure justice, prevent miscarriage.
Mandatory:
- Inquiry Officer independent
- Opportunity to inspect documents
- Right to defence assistant (union rep / lawyer if presenting officer is lawyer)
- Cross-examination
- Daily order sheet
- Enquiry report with reasons
Adverse Inference Rule 2025: 2025 INSC 554 - Supreme Court: Where State fails to produce original disciplinary record despite specific judicial direction, Court entitled to (i) draw adverse presumption under Sec 114(g) Indian Evidence Act, (ii) treat enquiry as vitiated.
Stage 5: Second Show Cause + Disciplinary Authority Decision
Enquiry report supplied to delinquent. ECIL vs B. Karunakar (1993) 4 SCC 727 Constitution Bench: Non-furnishing of report = violation, proper relief = reinstate with liberty to continue from stage of furnishing report, not automatic full reinstatement.
Disciplinary Authority must independently apply mind, not just rubber stamp IO report.
Stage 6: Penalty
Minor Penalties: Censure, withholding increment, recovery of loss.
Major Penalties: Reduction in rank, compulsory retirement, removal, dismissal.
Syndicate Bank vs Employee (SC 2024): Exercise of powers by disciplinary authority is always subject to principles of proportionality and fair play. Financial loss reimbursed cannot justify dismissal if misconduct not grave.
Stage 7: Appeal, Review, Revision
Within 45 days to Appellate Authority.
III. Key Judicial Doctrines - Case Laws
1. Judicial Review - Limited Scope
P. Gunasekaran (2015) 2 SCC 610 + K.S. Radhakrishnan AIR 1964 SC 477 - Applied in Calcutta HC 2023 upholding bank disciplinary actions for proven misconduct when dealing with public money.
- Court will NOT re-appreciate evidence. Only checks:
i) Rules of natural justice complied?
ii) No bias?
iii) Evidence supports finding? (not sufficiency, but existence)
iv) Penalty not shockingly disproportionate?
2. Criminal Case vs Departmental Inquiry - Can Run Parallel
State Bank of Bikaner & Jaipur vs Srinath Gupta - SC:
- Sec 161 CrPC statements admissible in disciplinary inquiry - standards differ - proof beyond reasonable doubt not needed, preponderance sufficient.
- CBI Inspector presence during inquiry does not vitiate if natural justice maintained.
Supreme Court in SBI vs Neelam Nag (2016) 9 SCC 491:
Clause 4 of MoS doesn't prohibit disciplinary proceedings but allows them if employee not tried within a year - criminal trial delay cannot stall discipline.
Acquittal in criminal case does NOT bar departmental inquiry - DY Chandrachud bench: Criminal acquittal due to benefit of doubt does not debar employer from proceeding - different standards.
3. Discipline After Retirement - Critical for Banks
UCO Bank vs M.B. Motwani (2020) + UCO Bank vs Krishna Kumar Bhardwaj (2022) + Rabindranath Choubey (2020):
- 1979 Regulations could only be used when disciplinary action had begun before employee's service ended.
- Even if employee reached superannuation, he would only be considered to be in service if legitimate departmental proceeding started before retirement.
- If charge sheet issued after retirement, proceedings void - pension cannot be withheld.
- For 1976 Officer Regulations: Reg 6 conduct - must be initiated before superannuation.
4. Time Limit - Proceedings Cannot Be Endless
Supreme Court 2024: Disciplinary Proceedings Beyond Court-Ordered Time Without Extension Are Illegal
Continuation beyond time stipulated by tribunal/court without seeking extension is unlawful. Violates judicial directives - invites interdiction.
Union of India vs Y.S. Sadhu (2008):
HC cannot order automatic reinstatement for procedural lapse. Instead, proceedings should continue from stage where error occurred, without reinstatement or back wages.
5. Discharge vs Dismissal vs Retrenchment
State Bank of India vs Workmen of SBI - SC:
Detailed statutory interpretation distinguishing discharge as disciplinary action and termination as retrenchment. Discharge under para 521(10)(c) Sastri Award results from disciplinary proceedings aimed at punishing misconduct - punitive, not retrenchment - therefore ID Act Sec 25F not applicable.
6. Proportionality & Compassionate Appointment
Bank of India vs Pankaj Srivastava:
Clause 10(iv) of compassionate appointment scheme disqualifies employees whose disciplinary proceedings could prima facie result in major penalty. Contemplation of disciplinary action suffices to bar dependent's claim, irrespective of whether formal proceedings commenced. Board Meeting directive 20 June 2002 further restricted.
Disciplinary Authority-cum-Regional Manager vs ... (SC):
Even if acts did not result in loss to bank and in some cases even yielded profits, if done beyond authority, it was breach of discipline, liable to be punished.
IV. Bank-Specific Framework - Practical Checklist
For Bank Management initiating action:
- Issue show-cause within 6 months of knowledge - delay weakens case.
- Ensure IO not from same branch / not complainant.
- Supply all documents listed in charge sheet - else grave prejudice argument.
- Record daily - no ex-parte unless employee refuses despite notice.
- Give Enquiry Report + 15 days to represent.
- DA must record independent reasons - "I agree with IO" insufficient.
- Penalty must be proportionate - consider past record, loss reimbursed, length of service - per Syndicate Bank SC.
- Communicate appeal remedy.
For Employee Defending:
- Demand documents, ask for defence assistant.
- Challenge charge sheet vagueness.
- If enquiry record not produced by bank despite direction, invoke adverse presumption 2025 INSC 554.
- If acquitted in criminal case on merits (not technical), use as mitigation for proportionality.
- If proceedings beyond court time, seek quashing.
V. Remedy Hierarchy
Internal Appeal -> Review -> High Court under Art 226 (limited judicial review) -> Supreme Court.
High Court will not interfere at charge sheet stage unless wholly without jurisdiction or mala fide.
