Dispute Resolution In Banking

1. Types of Banking Disputes

  • Lender-Borrower: NPA, SARFAESI possession, interest overcharge, foreclosure
  • Bank-Customer: Service deficiency, mis-selling, recovery agent harassment, locker, unauthorized transaction
  • Bank-Bank: Inter se assignment, consortium disputes
  • Bank-Regulator: RBI penalty, audit

Each has different resolution mechanism.

2. Tier 1: Internal Dispute Resolution - Mandatory First Step

RBI Internal Ombudsman and Grievance Redressal under RBI Circular on Customer Service 2023

Every bank must have:

  • Branch level complaint
  • Nodal Officer - 21 days
  • Principal Nodal Officer - 30 days

If not resolved, customer can go to next tier.

Case law: RBI has made exhaustion of internal remedy mandatory for Banking Ombudsman. Complaint filed directly is returned.

3. Tier 2: RBI-Integrated Ombudsman Scheme, 2021 - Replaced 3 old Ombudsman Schemes

Effective 12 Nov 2021, merged Banking Ombudsman, NBFC Ombudsman, Digital Transactions Ombudsman.

Coverage:

  • Deficiency in service
  • Non-adherence to RBI guidelines on recovery agents, interest, charges
  • Digital frauds, unauthorized transactions - zero liability under RBI Circular of 2017
  • Mis-selling of third party products

Process: Complaint on CMS Portal - https://cms.rbi.org.in - No fee. Ombudsman can award compensation up to Rs.20 lakhs + Rs.1 lakh for harassment.

Case Laws:

1. ICICI Bank Ltd. v. Prakash Kaur 2007 - SC directed RBI Ombudsman mechanism to be strengthened for recovery agent harassment.

2. Reserve Bank of India v. Javed Ahmad Bhat - J&K HC 2015
Held Ombudsman award is binding on bank if not challenged by bank before Appellate Authority (Deputy Governor) within 30 days. Customer need not file civil suit.

3. PNB v. Banking Ombudsman - Delhi HC 2019
Ombudsman can go beyond contractual rate and order refund of penal interest if bank violated RBI Fair Practices Code.

4. Tier 3: Consumer Forum - Consumer Protection Act, 2019

Bank is service provider under Sec 2(42) CPA. Customer is consumer.

When to use Consumer Forum:

  • Service deficiency - Wrongful debit, cheque bounce due to bank fault, locker theft, ATM not dispensing, recovery agent abuse, non-issuance of NOC.
  • Cannot use for SARFAESI action - Express bar - Sec 34 SARFAESI and Sec 18 RDDB.

Important Case Laws:

4. Citicorp Maruti Finance Ltd. v. S. Vijayalaxmi 2011 12 SCC 443 - SC
Recovery agents using muscle power = deficiency in service + unfair trade practice. Compensation payable.

5. SBI v. Rajesh Kumar Agarwal 2023 NCDRC
Bank froze account without notice due to alleged fraud. Held deficiency. Bank must follow RBI Master Direction on Fraud - Must give hearing before classifying as fraud.

6. Charan Singh v. Healing Touch Hospital & Canara Bank - SC 2000
Bank wrongly dishonoured cheque - Account holder had sufficient funds. Held liable for loss of reputation, compensation Rs.5 lakhs for cheque bounce due to bank fault.

Limitation: Consumer Forum cannot decide complicated questions of interest rate, interpretation of loan agreement with disputed facts - Should go to Civil Court / DRT.

Case: Standard Chartered Bank v. B.N. Raman 2006 SC
Forum cannot grant relief on SARFAESI possession - Jurisdiction barred.

5. Tier 4: Debt Recovery Tribunal - RDDB Act, 1993 and SARFAESI Act, 2002

For Bank to recover: Banks with claim > Rs.20 lakhs file Original Application (OA) under Sec 19 RDDB Act before DRT.

For Borrower to challenge SARFAESI: File Securitisation Application (SA) under Sec 17 SARFAESI before DRT within 45 days of measure.

This is main battleground.

Foundational Case Laws:

7. Mardia Chemicals Ltd. v. Union of India 2004 4 SCC 311 - SC - Constitution Bench - SARFAESI Constitutionality
Challenged SARFAESI as draconian.
SC upheld SARFAESI but held:

  • Borrower must get notice u/s 13(2) - 60 days to reply
  • Bank must consider reply with reasons - Sec 13(3A) - Added after this judgment
  • Borrower can approach DRT u/s 17 even before physical possession - Right to hearing
  • Requirement to deposit 75% to approach DRT struck down as unreasonable - Later amended to 50% max.

8. Transcore v. Union of India 2008 1 SCC 125 - SC
DRT and SARFAESI remedies are concurrent, not mutually exclusive. Bank can withdraw OA and take SARFAESI, and vice versa. Assignment to ARC under Sec 5 valid.

9. Authorized Officer, Indian Overseas Bank v. Ashok Saw Mill 2009 8 SCC 366 - SC
DRT under Sec 17 can restore possession even after auction sale if SARFAESI procedure illegal. Wide powers.

10. Phoenix ARC Pvt. Ltd. v. Vishwa Bharati Vidya Mandir 2022 5 SCC 345 - SC
DRT cannot go into title disputes. ARC steps into shoes of bank after assignment. Borrower cannot challenge assignment deed in DRT, only before Civil Court, but can challenge lack of authority.

11. Anup Karan Singh v. Central Bank of India 2020 SC
Limitation for SA under Sec 17 is 45 days from date of possession notice, not from 13(2). Article 62 of Limitation Act not applicable.

12. Kotak Mahindra Bank v. Hindustan National Glass 2013
Assignment must be by registered instrument and notice to borrower mandatory.

6. Tier 5: Civil Court / Commercial Courts - For Non-SARFAESI, Non-DRT Claims

  • Loans < Rs.20 lakhs
  • Locker disputes - Amitabha Dasgupta v. United Bank of India 2021 SC - Locker - Bank is bailee + bailor, liable if not exercising due care. RBI Locker Rules 2021 after this.
  • Guarantee / Indemnity disputes
  • Title disputes

Bar: Sec 18 SARFAESI bars Civil Court when DRT has jurisdiction. Sec 34 - No Civil Court can injunct SARFAESI action.

Case: SBI v. Emmsons International 2011 Delhi HC
Civil Court can grant injunction against encashment of LC/BG only in case of fraud of beneficiary to knowledge of bank and irretrievable injustice - Federal Bank v. V.M. Jog Engineering 2001 test.

7. Tier 6: Arbitration and Mediation

Many loan agreements have arbitration clause - especially consortium, MSME, NBFC.

Position after 2020:

13. Vidya Drolia v. Durga Trading Corp 2021 2 SCC 1 - SC - Landmark on arbitrability
Banking disputes where only SARFAESI/DRT has exclusive jurisdiction are non-arbitrable. Fraud claims with public interest not arbitrable. But mere loan recovery with arbitration clause is arbitrable if bank chooses arbitration instead of DRT, provided claim <20 lakhs or parties agree.

14. Branch Manager, Magma Leasing v. Potluri Madhavilata 2009 10 SCC 103 - SC
Arbitration clause in hire-purchase / loan agreement - Bank repossessing vehicle without arbitration - Held: Arbitration clause does not bar bank from taking possession under agreement if agreement provides, but must follow due process, no force.

New Law: Mediation Act, 2023
RBI in 2023 directed banks to attempt mediation under Mediation Act for MSME and retail loans before SARFAESI - Voluntary but encouraged.

8. Tier 7: Lok Adalat and One Time Settlement (OTS)

  • Lok Adalat under Legal Services Authorities Act, 1987: Every DRT conducts Lok Adalat. Settlement is deemed decree - No appeal.
  • RBI Framework for Compromise Settlement and Technical Write-off 2023: Allows OTS for willful defaulters also with Board approval.

Case: State Bank of India v. Vijay Kumar - P&H HC
OTS is contractual - If borrower fails to pay OTS amount in time, bank can cancel OTS and revive original claim.

9. Which Forum to Choose? - Strategy Matrix

10. Emerging Trends

  • Digital Lending Disputes: RBI Digital Lending Guidelines 2022 - Lending Service Provider liable, data localization.
  • Video-based ODR: DRTs now allow video hearings - DRT Rules 2024 amendment.
  • Account Aggregator disputes: New Ombudsman category.

Golden Rule from Supreme Court in ICICI Bank v. Official Liquidator 2010: Banking dispute resolution is not about which forum is superior, but which forum is not barred. Always check Sec 17, 18, 34 SARFAESI bar before filing civil suit or consumer case, otherwise case will be dismissed at threshold.
