Dispute Over Claim Settlement

1. What is Dispute Over Claim Settlement?

Dispute arises when insurer and insured disagree on:

  • Delay beyond time specified in IRDAI regulations
  • Partial or Total Repudiation of claim
  • Quantum - how much payable - surveyor vs insured
  • Legal construction of policy - whether exclusion applies

IRDAI seeks standard definition: Claim should only be considered settled when client confirms satisfaction. Until then claim remains pending / disputed. If claim repudiated, policyholder can legally dispute it within 3 years of repudiation and will remain disputed till court disposes it off.

2. IRDAI Regulatory Timetable - Protection of Policyholders Interest Regulations 2017

This is law that creates dispute if not followed:

For General Insurance:

  • 24-hour acknowledgement of claim intimation
  • 72-hour surveyor appointment
  • 15-day survey report
  • 30-day settlement offer after receiving all relevant papers
  • If repudiation - must be in writing with reasons, referring to corresponding policy conditions + grievance redressal procedure + Ombudsman address

For Life Insurance:

  • Within 30 days, claim shall be paid or shall be disputed, provided company has received all relevant papers

Any deviation = ground for dispute before Ombudsman.

3. Dispute Resolution Hierarchy

  1. Grievance Redressal Officer [GRO] of Insurer: First step - written representation with policy, proposal, claim docs, surveyor report, medical/police record
  2. IRDAI Bima Bharosa Portal: Tier 2
  3. Insurance Ombudsman: Free, faster, for individual policyholders with claim disputes up to Rs 50 lakh - hears complaints about repudiation, delay, premium dispute, legal construction of policies as far as it relates to claims
  4. Consumer Commission: District / State / NCDRC - deficiency in service, unfair trade practice
  5. Commercial Court / Arbitration: For high value - but arbitration clause has trap - see case law below

4. Leading Case Laws - Supreme Court and NCDRC

Case 1: New India Assurance Co. Ltd. vs Luxra Enterprises Pvt. Ltd. (2019) INSC 403 - Surveyor Report Sanctity

Facts: Insurer appointed first surveyor, report assessed loss Rs 54.9 lakhs. Insurer unhappy, appointed second, third surveyor with lower assessment. Repudiated based on later reports.

Supreme Court Held: Insurance company cannot appoint multiple surveyors to keep getting favourable report. Directed company to pay Rs 54,93,865 with 6% interest from date of petition. Ratio: Under Sec 64 UM Insurance Act 1938, surveyor report is important, cannot be brushed aside. Insurers must act fairly and transparently in settlement.

Use for project: If dispute is over quantum, first surveyor report prevails unless shown perverse.

Case 2: Arabian Exports Pvt. Ltd. vs National Insurance - Full and Final Settlement Voucher - Coercion

Facts: Insured signed discharge voucher "full and final settlement" for lesser amount due to financial pressure, then raised dispute for balance.

Supreme Court Held: Signing full and final settlement voucher does NOT automatically close case. Arbitrator has power to decide whether settlement was truly voluntary or result of coercion / undue influence. If forced due to financial pressure, dispute can be reopened and sent to arbitration.

Most cited case in claim settlement disputes. Insurers cannot force insured to sign discharge.

Case 3: Supreme Court - Insurance Company Cannot Take Defence Which Did Not Form Basis of Repudiation

Facts: Insurer repudiated claim stating ground: no sufficient balance to cover declaration. Before consumer commission, took new defence: non-disclosure, fraud.

Supreme Court Held: In claim before consumer commission, insurer cannot take defence which did not form basis of repudiation. Ground for repudiation was that there was no sufficient balance - cannot later invent new ground. Repudiation letter must contain all reasons.

Principle: What is not in repudiation letter cannot be argued later.

Case 4: Delay in Notification Does Not Justify Repudiation - Supreme Court Feb 11, 2022 - Oriental Insurance Co. Ltd. vs...

Facts: Theft claim intimated after delay of few days. Oriental repudiated citing delay clause.

Supreme Court Held: Mere delay in informing insurance company about theft does not justify complete repudiation. Upheld State Commission dismissal of appeal by insurer. Unless delay causes prejudice and makes investigation impossible, claim cannot be fully rejected. At most, small percentage deduction for delayed intimation if IRDAI guidelines allow, but not total repudiation.

Now codified: IRDAI says delay not ground for total repudiation for non-life.

Case 5: Karnavati Veneers vs New India Assurance (2023)

Facts: Repudiation invoking condition 6(b) - non-cooperation.

Held: Court: Invoking condition 6(b) for repudiation dated 11 Sept 2007 was unsustainable. Whatever material documents available with insured were indisputably made available to surveyor. Repudiating claim invoking clause 6(b) was unfair and not legally sustainable.

Case 6: New India Assurance vs Tata Steel Ltd. 2024 INSC 356

Facts: Dispute over claim allowed as per insurance policy - applicability of prior case law Oswal Plastic Industries dismissed.

Supreme Court Held: Set aside NCDRC order and upheld insurer's settlement of claim. Claim to be allowed as per insurance policy wording, not on equity. If policy clearly excludes, even consumer forum cannot grant.

Balances Karnavati - shows court will uphold valid repudiation.

Case 7: United India Insurance vs Bansal Wood Products 2025 INSC 39 - Interest for Delay

Question: Can insurer be held liable to pay interest for delays when claimant also contributed to delay by pursuing consumer complaint before arbitration?

Held: Supreme Court modified interest award - considered specific circumstances where claimant pursued consumer complaint before arbitration, leading to delays. Interest reduced but not eliminated.

Principle: Insurer liable for interest for delay beyond 30 days even if dispute pending, but if claimant also causes delay, interest may be apportioned.

Case 8: Shyam Lal Jayaswal vs Oriental Insurance (2020) - Procedure

NCDRC reduced claim amount suo moto. Supreme Court restored State Commission order which insurer had not challenged. Held: If party does not challenge order from lower forum, cannot benefit from reduction by higher forum when challenge made only by opposing party.

Case 9: Arbitration Clause Trap - Three Parts

Arbitration clause typically has 3 parts:

  1. Disputes over quantum go to arbitration
  2. No arbitration if insurer completely denies liability
  3. Obtaining arbitration award is condition precedent to filing suit

Supreme Court Held: Complete denial of liability by insurer means dispute falls under part 2, so arbitration not required and insured can directly sue in court. Clarified law - total repudiation = can go to consumer forum / court, not forced to arbitrate.

5. How to Argue Dispute Over Claim Settlement in Project / Consumer Case

For Insured:

  1. Show repudiation letter did not state specific policy condition - violates IRDAI Health Insurance Regs 2016 - repudiation must refer to corresponding policy conditions
  2. Show delay in settlement beyond 30 days - deficiency
  3. Show coercion in full and final settlement - Arabian Exports case
  4. Show new defence taken beyond repudiation - prohibited

For Insurer:

  1. Show material suppression - uberrima fides - proposal form fraud
  2. Show surveyor report supports repudiation - Luxra case but first surveyor only
  3. Show claim within exclusion - Tata Steel case - claim as per policy

Limitation: 3 years from repudiation to dispute legally, as per IRDAI former member KK Srinivasan.
