Privacy Law at Maldives

As of April 2025, the Maldives is in the process of developing a comprehensive legal framework for data protection and privacy. While the Data Protection Act 2017 was enacted to safeguard individuals' privacy rights, the government is currently working on more robust legislation to address the evolving digital landscape. 

Existing Legal Framework

Data Protection Act 2017  Enacted on January 15, 2018, this Act established the foundation for data protection in the Maldive.  It outlines principles for the collection, use, and disclosure of personal data, emphasizing the rights of individuals to control how their personal information is use.  The Act also defines the roles and responsibilities of data controllers and processors, aiming to protect individuals' privacy in the face of advancing technology.  

🏛️ Ongoing Legislative Development

 Recognizing the need for more comprehensive data protection laws, the Maldivian government is currently drafting new legislation:  

*Personal Data Protection Bill:  This bill aims to establish a more robust framework for the collection, use, and disclosure of personal data   It seeks to balance individuals' rights to privacy with organizations' needs to process data for legitimate purpose   The bill is currently under consultation, with input from various stakeholders, including government agencies, private sector partners, and international experts.

*National Cybersecurity Bill:  In conjunction with the data protection bill, the government is also developing a cybersecurity bill to enhance the security and resilience of digital systems in the Maldives   This bill aims to establish a comprehensive framework for cybersecurity, addressing issues such as data breaches, cyber threats, and the protection of critical infrastructure.  

📌 Summary

 While the Maldives has laid the groundwork for data protection with the 2017 Act, ongoing legislative efforts are underway to strengthen and expand the legal framework.   The forthcoming Personal Data Protection Bill and National Cybersecurity Bill are expected to provide more comprehensive protections for individuals' personal data and enhance the security of digital systems in the country.
