Privacy Law at Ivory Coast

Côte d'Ivoire has established a comprehensive legal framework for personal data protection, primarily through Law No. 2013-450, enacted on June 19, 2013. This legislation aligns with regional standards set by the ECOWAS Supplementary Act on Personal Data Protection (2010) and international agreements like the Malabo Convention on Cybersecurity and the Protection of Personal Data, which Côte d'Ivoire ratified in February 2023

Law No. 2013-450 This law governs the processing of personal data in Côte d'Ivoire, establishing principles such as legality, purpose limitation, data minimization, and consent 

Decree No. 2015-79 Issued on February 11, 2015, this decree outlines the procedures for declaring and authorizing personal data processing activitiesual reporting by data controllers and their designated data protection correspondents to the ARTCI

The Autorité de Régulation des Télécommunications/TIC de Côte d'Ivoire (ARTCI) serves as the national data protection authoriy Established as an independent administrative body, the ARTCI is responsible for ensuring compliance with data protection laws and safeguarding individuals' privacy rights 

⚖️ Enforcement and Sanction

The ARTCI has the authority o:

Issue warnings or reprimands to non-compliant entitis.

Suspend or revoke authorizations for data processing activitis.

Impose financial penalties, with fines reaching up to CFA 10 million (approximately €15,000), depending on the severity of the violation rsonal data collection and processing by organizations, requiring prior notification and authorization for certain processing activities

📌 Key Principle

Under Law No. 2013-450, personal data processing must adhere to the following principes:

*Legality: Processing must be lawful and transparnt.

*Purpose Limitation: Data should be collected for specified, legitimate purposes and not further processed in ways incompatible with those purpoes.

*Data Minimization:Only data necessary for the intended purpose should be colleced.

*Consent: Data subjects must provide explicit consent before their data is processed

🧭 Recent Developmets

In 2023, Côte d'Ivoire commemorated the 10th anniversary of Law No. 201340.The ARTCI utilized this milestone to assess the law's impact and discuss future enhancements, including adapting regulations to address emerging technologies like artificial intelligence and the Internet of Things
