1. Legal Framework - India
A. Bankers' Books Evidence Act, 1891 [BBEA] - Still in force after BSA 2023
- Sec 2(3) & 2(8): Defines Bankers' Books includes ledgers, day books, cash books, account books, and all records used in ordinary business of bank, including electronic form.
- Sec 2A: Added for electronic records - Printout of electronic bank record deemed to be document. Conditions:
(a) printout was produced by computer in regular use
(b) computer was operating properly
(c) information is derived from information fed in ordinary course - Sec 4: Mode of proof - Subject to Act, certified copy of any entry in banker's book shall in all legal proceedings be received as prima facie evidence of existence of such entry and shall be admitted as evidence of matters therein as if original.
Who can certify? Officer with custody of books. Certificate must state:
- That copy is true copy
- That books were at time of entry ordinary books of bank
- That entries were made in usual and ordinary course of business
- That books are in custody/control of bank
- Plus Sec 2A certificate for electronic.
B. Bharatiya Sakshya Adhiniyam, 2023 [BSA] - New Evidence Act from 1 July 2024
- Sec 28: Entries in books of account, including those maintained in electronic form, regularly kept in course of business are relevant whenever they refer to matter into which Court has to inquire. But Proviso: Such entries alone shall not be sufficient to charge any person with liability - needs corroboration.
- Sec 57: Electronic and digital records are Primary Evidence.
- Sec 63: Admissibility of electronic records. Requires certificate under 63(4) similar to old 65B. BUT BBEA is special law.
Hierarchy: Special law prevails over general law.
2. Indian Case Laws - The Core
1. Indian Bank v. Satyam Fibres (India) Pvt. Ltd. (1996) SC - Foundation
- Held: Bank statements, when certified by bank, are considered prima facie evidence of transactions. If no contrary evidence provided, they can be treated as conclusive.
- Principle: Certified copy = prima facie, shifts burden to defendant.
2. Raquib Ansari vs Udayveer Singh, Civil Suit No. 222/2021, 24 April 2023 - Most Important Current
- Held:
ADMISSIBILITY OF ELECTRONIC BANK RECORDS - Banking records maintained in electronic forms are admissible. However, such records are required to be proved in manner provided in Section 2A r/w Section 4 of The Bankers' Books Evidence Act, 1891 and not as per Section 65B of Indian Evidence Act.
- Clarifies conflict between BSA/IEA 65B certificate and BBEA - BBEA certificate sufficient for bank electronic records. You do NOT need 65B certificate if you have 2A certificate.
3. Anvar P.V. vs P.K. Basheer & Arjun Panditrao Khotkar v Kailash Gorantyal SC - General Rule
- Anvar held 65B certificate mandatory for electronic records. Khotkar clarified procedure.
- But for banks, BBEA is special law - so Raquib Ansari exception applies.
4. Punjab & Sind Bank v. Ram Prakash Jagdish Chander, Delhi HC 16 Feb 1990
- Strengthened bank's evidentiary position under BBEA. Held bank can prove debt by certified copy, need not produce original ledger if certified properly. Cited Punjab National Bank Ltd. Delhi v. Vinod Kumar, AIR 1957 Punjab 257 which established copy certified under BBEA serves as prima facie evidence.
5. ICICI Bank Ltd vs Sunil Sharma - Delhi 2018 + C.B.I vs B. Raghubir Acharya 2015 Supreme(Bom)

- Held: Detailed ingredients mentioned in defining clause 8 of Sec 2 of BBEA for qualifying to be certified copy are not mandatory but merely directory.
- If substance complied - true copy, ordinary course, custody - minor technical omission does not make statement inadmissible. Prevents debtors escaping on technicality.
7. Sadanand Vs Sandeep Devidas Fate and Ors.
- Held: Certified copy which includes print out must be accompanied by certificate as contemplated in Section 2-A (a),(b),(c) of BBEA. Printout of Buldana Urban Co-op Bank and SBI governed by special enactment.
8. Central Bureau of Investigation v. V.C. Shukla SC
- Landmark: Entries in books of account alone are insufficient to charge person with liability unless supported by corroboration. Sec 28 BSA reiterates this. Bank entry alone cannot prove you took bribe - need witness or payee proof.
- Applied in CBI vs V.C. Shukla Jain Hawala case - diary entries not enough.
3. International / Common Law Cases - For Exam
9. Bank of Scotland Ltd v. Fergus, Supreme Court of Ireland, 18 Dec 2019 - Pivotal

10. Bank of Scotland Plc v. Stapleton, High Court 29 Nov 2012
- High Court overturned summary judgment because BBEA not complied - affidavit not stating books in ordinary course. Proving bank debt requires strict BBEA compliance.
11. Promontoria (Aran) Ltd v Burns - Irish High Court
- Credit servicing firms, BBEA 1879-1959, and loan sales. Issue: Can vulture fund buying loan from bank prove debt using BBEA?
