Execution Stage Hurdles .

1. Fundamental Principle - Executing Court Cannot Go Behind Decree

Vasudev Dhanjibhai Modi v Rajabhai Abdul Rehman AIR 1970 SC 1475 - Landmark

Executing court cannot go behind decree. Its sole function is to execute decree as it stands. Only exception - decree without jurisdiction is nullity and can be challenged at execution - Kiran Singh v Chaman Paswan 1954.

If decree is otherwise wrong, you must appeal, not object in execution.

2. Major Hurdles Category Wise

Hurdle 1 - Section 47 CPC - Questions to be decided by Executing Court

All questions relating to execution, discharge, satisfaction of decree between parties or their representatives to be decided by executing court, not separate suit.

Latest: Periyammal v Rajamani 2025 INSC 329 + Section 47 CPC: SC Holds Property Right Disputes = Original Suits? Bhatt & Joshi Analysis

Supreme Court held any application filed under Sec 47 CPC which raises questions about property rights, title, interest will be treated as application under Order 21 Rule 97. Court ruled that application under Sec 47 raising property right disputes must be adjudicated under Order 21 Rule 97, not as Sec 47.

Intent: Prevent misuse of Sec 47 to stall.

Barkat Ali v Badrinarain (Dead) - SC: After preliminaries - notice under Order 21 Rule 22 and court proceeded to next stage of attaching property under Rules 23 and 24, any objection raised subsequent thereto cannot be entertained being barred by constructive res judicata.

So delay in raising Sec 47 objection = barred.

Hurdle 2 - Obstruction by Third Party - Most Common - Order 21 Rules 97 to 101 - Complete Code

Picture:

  • Decree for possession - Bailiff goes with warrant under Rule 35
  • Third party obstructs - "I am owner, not JD"
  • Decree-holder cannot take police help directly - must file application under Rule 97 for removal of obstruction

Brahmdeo Chaudhary v Rishikesh Prasad Jaiswal 1997 (2) LW 266 - Classic exposition by SC - cited in all HC:

Conjoint reading of Rules 97, 98, 99, 101 projects picture:
If decree-holder is resisted or obstructed in execution for possession with result that decree could not be executed in normal manner by obtaining warrant under Rule 35 then decree-holder has to move application under Rule 97 for removal of obstruction and after hearing decree-holder...

Rule 98: If resistance by JD or person at his instigation, court to direct removal + JD can be detained.

Rule 99: If third party dispossessed by execution, he can file application complaining dispossession.

Rule 101: All questions including right, title, interest arising between parties to proceeding on application under Rule 97 or 99 shall be adjudicated - deemed suit. Order under Rule 98/100 appealable as decree under Rule 103.

Recent - Jini Dhanrajgir v Shibu Mathew (2023) SCC Online SC 643: Executing Court could not dismiss execution petition by treating decree to be inexecutable merely on basis that decree-holder lost possession to third party/encroacher. Rules 97 to 103 provide complete mechanism, must adjudicate.

Supreme Court Prevents Misuse 2024: Any application filed under Sec 47 which raises property rights to be treated as Rule 97 application - prevents parties from using Sec 47 to avoid adjudication under 97-101.

N. Palaniappan v G. Pandurangan - Madras: Under Rule 97, enquiry by executing court in execution application for removal of obstruction was summary one, concerned only with question of present possession and under Rule 98 if resistance by JD or some person at his instigation, court had to direct removal.

Hurdle 3 - Claim Petition under Rule 58 - Attachment before judgment

Third party claims attached property is his, not JD's. Must file claim under Order 21 Rule 58 - adjudicated before sale. If fails, remedy appeal under Rule 58(4).

Hurdle 4 - Auction Sale Challenges - Rules 66, 89, 90

G.R. Selvaraj v K.J. Prakash Kumar - SC 2023-24 - Landmark on Rule 66(2) vs Rule 90:

SC clarified long-standing confusion: Grounds which could have been raised at time of settling sale proclamation under Rule 66(2) cannot later be used to attack sale under Rule 90. Auction sale cannot be challenged on grounds that could have been raised before proclamation - statutory bar under Rule 90(3).

So JD must object at proclamation stage, else loses right.

Challani Ginning and Pressing Factory v Kamal - SC 2024:

Court reaffirmed important rule: Parties cannot stall execution by filing delayed objections. Objector must act in time. If party had knowledge and opportunity earlier, cannot raise objections at late stage. Rules 97-101 provide complete mechanism but parties must use it in time.

Hurdle 5 - Stay / Insolvency / Death

  • Insolvency: On IBC moratorium Sec 14, execution stayed
  • Death of JD: Legal heirs to be brought under Order 22 - else execution void
  • Transfer pending execution: Sec 52 - transferee pendente lite bound by decree

Hurdle 6 - Money Decree - Arrest, Attachment, Garnishee

Order 21 Rules 11, 37-40: DH must file written execution petition with certified copy of decree. For money decree, can seek attachment of salary, bank account (garnishee Order 21 Rule 46), arrest under Rule 37 if JD has means but refuses.

Jolly George Varghese v Bank of Cochin (1980) SC: Arrest for inability to pay debt violates Art 11 ICCPR unless willful refusal.

Hurdle 7 - Time - Limitation

Execution must be filed within 12 years under Art 136 Limitation Act from when decree becomes enforceable. After 12 years, inexecutable.

3. Expeditious Execution Framework - New Judicial Direction

Periyammal 2025 INSC 329 + Rahul S Shah v Jitendra Kumar 2021:

SC gave directions to High Courts to expedite execution, reveal robust stance on preventing undue hindrances in post-decree stage:

  1. Executing court to decide Rule 97 applications within 6 months
  2. No separate suit if remedy under Rules 97-101 available
  3. Police help can be granted without separate Rule 97 application if obstruction by JD himself - but if third party bona fide, must adjudicate
  4. High Courts to monitor oldest execution petitions via monthly report

4. Strategy to Overcome Hurdles

For Decree Holder:

  • File execution immediately with transfer certificate if JD assets in other jurisdiction under Order 21 Rule 5 & 6
  • If obstruction anticipated, file Rule 97 application with prayer for police aid and detention
  • Insist on adjudication under Rule 101 - all questions decided, no second round
  • Object to belated objections citing Challani Ginning (delayed objections barred) + Barkat Ali (constructive res judicata)

For Judgment Debtor / Third Party Objector:

  • File objection at earliest - Rule 22 notice stage - else barred
  • File Rule 58 claim before sale, Rule 99 after dispossession
  • Prove independent right - not at instigation of JD - produce title deed, possession before decree
  • File appeal under Rule 103 - treated as decree, not revision

Core Maxim: Execution is not to be stalled by filing frivolous objections - Supreme Court in 2025 said any Sec 47 application raising title must be treated as Rule 97 and decided on merits quickly, not dismissed.
