Digital Banking Complaint Redress Mechanism

Tier 0: Inside the Bank - Mandatory First Step

You cannot directly jump to RBI or Consumer Court.

RBI Rule: You may approach grievance redressal cell of your bank with details of disputed transaction. In case your grievance is not resolved within 30 days, you may make complaint under RB-IOS 2021.

What to file inside bank:

  • Written email to Nodal Officer + Principal Nodal Officer - not just branch manager
  • Mention RBI Circular 6 July 2017 - Customer Protection - Limiting Liability
  • Demand 10-day provisional credit under zero liability
  • Keep acknowledgment - 30-day clock starts from this

If bank says "customer shared OTP, so liable" - that is NOT a resolution. Clock still runs.

Tier 1: RBI Integrated Ombudsman Scheme, 2021 - RB-IOS - One Nation, One Ombudsman

Evolution:
2006 Banking Ombudsman Scheme → 2018 NBFC Ombudsman → 2019 Digital Transactions Ombudsman → 2021 RB-IOS merging all three schemes, operating from single portal/email, providing single centralized reference point.

Key Features:

  • Integration of three schemes into one - Banking, NBFC, Digital Transactions - into one scheme. Streamlines grievance redressal process, centralizes complaint receipt, expands coverage, eliminates jurisdictional disparities.
  • Cost-free redress of customer complaints
  • Jurisdiction-neutral - you can file from anywhere at https://cms.rbi.org.in
  • Covers banks, NBFCs, Payment System Participants like PhonePe, Google Pay, Paytm
  • Ombudsman empowered to pass awards, up to Rs 20 lakh compensation for mental agony + full transaction amount
  • If dissatisfied, escalate to Appellate Authority within RBI - Executive Director, Consumer Education and Protection Dept

When to use RB-IOS vs Consumer Court?
RB-IOS is faster - 60-90 days, free, but award limited to Rs 20 lakh. For higher compensation and interest, go to Consumer Commission.

Tier 2: Consumer Commissions - District, State, NCDRC - Judicial Route

This is where case laws matter most. You can file parallel to RB-IOS - they are not mutually exclusive.

Procedure as per Consumer Protection Act, 2019:

  • District Commission up to Rs 1 crore
  • State Commission Rs 1-10 crore
  • NCDRC above Rs 10 crore

Bank cannot argue "complex fraud, need civil court" - NCDRC repeatedly holds digital fraud is deficiency in service.

Tier 3: Cyber Crime + Banking Ombudsman + Court

  • 1930 Cyber Crime Helpline + cybercrime.gov.in - for blocking beneficiary account within golden hour
  • Civil / Criminal Court - for FIR under IT Act 66C, 66D, BNS

Landmark Case Laws on Redress Mechanism

CASE 1: Retired Bengaluru Botany Professor vs SBI - Rs 12.93 Lakh - Three Forums, One Verdict: SBI Loses at Every Level

Facts: Professor K P Sreenath, Rs 12,93,922 fraudulently withdrawn from SBI Nagarabhavi branch, Bengaluru. SBI claimed professor shared OTPs.

Journey:
Level 1 - 2021 District Consumer Commission, Bengaluru - Rejected SBI's claim that professor shared OTPs
Level 2 - State Commission - Upheld
Level 3 - NCDRC - Bench of Justice A P Sahi and Bharatkumar Pandya, during second appeal brought forth by SBI, directed SBI to refund nearly Rs 12.93 lakh, ruling case falls under RBI zero liability framework. This ruling was made during second appeal.

Principle: Once you report within 3 days, burden shifts to bank. Bank must prove gross negligence with logs, not just allegation.

CASE 2: Rs 20 Fake Electricity Bill -> Rs 1.99 Lakh Fraud - SBI vs Customer - NCDRC

Facts: Customer tried to pay Rs 20 electricity bill via link, Rs 1.99 lakh siphoned.

Held: NCDRC upheld state commission direction ordering bank to re-credit Rs 1.99 lakh plus compensation Rs 25,000. Commission directed if amount not paid within 4 weeks, SBI liable to pay interest at 8% p.a. from date of default until realisation. Banks cannot pass buck when customers promptly report unauthorised transactions, holding SBI liable to fully refund.

This is now cited as "Electricity Bill Scam" precedent.

CASE 3: Driver Stole Rs 63 Lakh from Senior Citizen's SBI Account - Hyderabad - Rs 97 Lakh Compensation

Facts: Driver managed to change SBI net-banking access from view-only to transaction and prematurely broke FDs kept by senior citizen couple via SBI YONO app.

NCDRC Investigation: Both Telangana State Commission and NCDRC ruled SBI provided deficient service by allowing view-only access to be converted to transaction facility access without proper verification, which led to fraud. Fight escalated to NCDRC and went on for six years. Ordered Rs 97 lakh compensation.

Principle: Token deactivation gap and access conversion without fresh device verification = deficiency.

CASE 4: SBI Cloned ATM - Rs 3.60 Lakh Pensioner - NCDRC

Upholding orders, NCDRC directed SBI to pay Rs 3.60 lakh fraudulently withdrawn using cloned ATM and Rs 15,000 towards mental harassment. SBI failed to produce CCTV footage of ATM.

Principle: Bank must produce evidence - CCTV, device logs. Failure = adverse inference.

CASE 5: Rajinder Kumar Mittal vs SBI Cards - OTP Sharing Exception

NCDRC held disclosing OTP to stranger is in gross violation of person's own security provided by bank and in such event liability of bank lapses and onus on complainant entirely and upheld revision petition of bank setting aside order of Rajasthan SCDRC which had allowed appeal of complainant.

Exception: If you share OTP knowingly for financial transaction after being warned, you lose zero liability. This is the only case where bank wins.
