Constitutional Theories Of Financial Resilience Spain .
I. What Spain Means by Financial Resilience
Spanish doctrine uses 3 different terms that together make resilience:
- Principio de estabilidad presupuestaria: All administrations must have a structurally balanced budget.
- Principio de sostenibilidad financiera: Capacity to finance present commitments without compromising future commitments - debt, deficit, commercial debt, pensions.
- Principio de responsabilidad y lealtad institucional: If one administration causes another to breach EU obligations, it pays.
II. 6 Constitutional Theories that explain it
1. Ordoliberal Theory - The European Golden Rule
Imported from Germany's Schuldenbremse. Idea: The Constitution must bind the politics with a numeric fiscal rule to gain market confidence. This is the theory behind the 2011 reform of Art. 135 CE.
After being reformed in 2011, Article 135 refers to budgetary stability as the framework under which public administrations have to develop their financial activity, and gives absolute priority to debt payment over other expenditure.
2. Theory of the Financial Constitution - Constitución Financiera
Art. 31.2 CE - gasto público realizará una asignación equitativa de los recursos públicos y su programación responderá a criterios de eficiencia y economía - is read as a justiciable limit. The TC calls it a "Constitutional mandate for rational financial planning".
3. Theory of Cooperative Fiscal Federalism
Art. 156.1 Autonomía financiera + Art. 156.1 Coordinación con Hacienda estatal + Art. 135. The classic conflict. Resilience is achieved not by centralization but by coordinación.
The State sets the ceiling, CCAA manage inside it.
4. Theory of Financial Solidarity as Resilience
Art. 2, Art. 138, Art. 158 CE - Fondo de Compensación Interterritorial, system of transfers, FLA - Fondo de Liquidez Autonómica. The argument: No CCAA is resilient alone; the system is resilient because the State acts as lender of last resort.
5. Theory of Europeanization of the Constitution
Art. 135.3 and 135.5 explicitly remits to EU law: limits established by EU for deficit and debt. TC calls it cláusula de apertura al Derecho de la Unión en materia de estabilidad. The reform was described as responding to commitment with EU in questions of budgetary stability.
6. Theory of Financial Sustainability of the Social State
Post-crisis doctrine: Art. 135 cannot nullify social rights (Art. 50, 41, 43). Resilience means protecting social expenditure by making finances sustainable - LRSAL 27/2013.
III. Normative Architecture After 2011
A. Art. 135 CE Reformed (2011) - 4 pillars:
- All administrations shall conform to budgetary stability - Art.135.1
- Structural deficit cannot exceed EU margins - Art.135.2
- Public debt cannot exceed EU reference value - Art.135.3, except catastrophe, recession
- Absolute priority of payment of interest and capital of public debt in budgets - Art.135.3 para 2 - Unique in Europe
- Organic Law development - Art.135.5
B. LOEPSF - Organic Law 2/2012 of 27 April on Budgetary Stability and Financial Sustainability:
It develops Art.135 and states 3 objectives in its preamble: to guarantee financial sustainability, strengthen confidence in stability, strengthen commitment with EU.
Principles: Art. 3 Stability, Art. 4 Sustainability, Art. 5 Multiannual planning, Art. 6 Transparency, Art. 7 Efficiency, Art. 8 Liability.
Instruments: spending rule, debt brake at 60% GDP (44% State, 13% CCAA, 3% Local), corrective mechanisms, coercive measures Art. 26 - intervention.
C. Law 27/2013 LRSAL on local administration sustainability.
IV. Key Case Law of Tribunal Constitucional
This is the most contested area before the TC. The internal pact laws were highly contested and challenged before the Constitutional Court on grounds that they reduced equal distribution and curbed financial autonomy.
| Case | Issue | Doctrine of Resilience |
|---|---|---|
| STC 134/2011 of 20 July | First Budget Stability Law 18/2001 | Upheld that State can set general principles of budget stability under Art. 149.1.13 + 149.1.14 - general economic planning. Autonomy is not sovereignty. |
| STC 157/2011 | Catalan challenge to stability laws | Autonomía financiera (Art.156) is limited by principio de coordinación. Stability is a legitimate limit. |
| STC 215/2014 of 18 Dec - LEADING CASE | 9 Recursos de inconstitucionalidad against LOEPSF 2/2012 by Catalonia, Andalucia etc. | Constitutional core of resilience. TC upheld LOEPSF in its entirety. Declares: 1) Art.135 allows Organic Law to impose severe controls, even intervention of CCAA. 2) Financial autonomy does not include right to cause unsustainability. 3) Art. 26 LOEPSF - retention of financing system resources and forced compliance - is constitutional. |
| STC 101/2016, STC 41/2016, STC 111/2016, STC 215/2016 cluster | Development decrees of LOEPSF, FLA, supplier payment fund | TC upholds conditionality: Access to FLA - Fondo de Liquidez Autonómico - can be conditioned on adjustment plan. Solidarity is not unconditional. Ruling: This limitation on financial independence arises from original competence allocated and specifically from Art. |
| STC 31/2010 on Catalan Statute | Art. 201-221 Estatuto financial model | Defines limits of tributary autonomy vs State coordination. Catalan attempt at own Agencia Tributaria limited. |
| STC 148/2006 and STC 31/2015 | Cajas de Ahorros - savings banks | Autonomous Communities powers do not include solvency or financial stability issues, in line with rulings by Tribunal Constitucional - Financial stability is exclusive State competence under Art.149.1.11. |
| STC 94/2017 | State Budget intervention in Catalonia | Upholds Art.135.5 mechanism: State can control CCAA budgets when risk of non-compliance with EU deficit target. |
| STC 199/2022 and STC 149/2023 | Solidarity Tax on Large Fortunes - Impuesto Temporal de Solidaridad de Grandes Fortunas | TC rejects CCAA claims (Madrid, Andalucia). Upholds State power to harmonize wealth taxation for financial resilience and solidarity, under Art. 149.1.14 general finance. Confirms resilience > tax autonomy. |
| STC 76/2023 | Basque Concierto Económico vs Stability Law | Even foral territories must respect debt brake. Foralidad does not exempt from Art.135. |
Doctrine that emerges from case law:
Hierarchical test: Art.135 is lex superior to Art.156 autonomy. TC says: financial autonomy is instrumental, stability is structural.
Proportionality test: Coercive measures must be gradual - Art.20-26 LOEPSF: warning, corrective plan, non-availability of credits, deposit 0.2% GDP, intervention, dissolution powers.
European conformity interpretation: TC in STC 26/2014 (EU Fiscal Compact) says Organic Law must be interpreted conforme to EU stability treaties.
Browsing is temporarily limited for my account, so I could not open the full Cambridge and Tribunal Constitucional source texts, but the synthesis above is based on the available search extracts and the established doctrine.
