Competition Law at Liberia

Liberia's competition law framework is evolving, with significant developments aimed at promoting fair market practices and consumer protection.

📜 Legal Framework

Liberia's competition law is encapsulated in the Liberian Competition Act, which was enacted to foster a competitive market environment. The Ministry of Commerce and Industry (MOCI) is responsible for enforcing this legislation. A notable enforcement action under this Act was the imposition of a US$25,000 fine on the Fouani Brothers Corporation for unilaterally increasing egg prices, signaling the government's commitment to upholding competition standards .

However, the Liberian Competition Act is currently not operational due to the absence of a functional National Competition Authority. This gap has prompted initiatives to establish a robust competition framework aligned with regional standards.

🤝 Regional Collaboration and Capacity Building

In May 2024, Liberia hosted a workshop organized by the ECOWAS Regional Competition Authority (ERCA). The event aimed to:

Analyze existing legal and regulatory provisions on competition in Liberia.

Identify gaps and collaborate with stakeholders to develop comprehensive competition and consumer protection laws.

Promote alignment with regional frameworks to ensure fair market practices 

ERCA emphasized the importance of establishing a National Competition Authority in Liberia to effectively enforce competition laws and contribute to regional economic integration 

🏛️ Institutional Developments

The Ministry of Commerce and Industry (MOCI) is actively engaged in the process of reviewing and strengthening Liberia's competition policies. Deputy Minister Wilmot A. Reeves highlighted the government's commitment to creating a competitive environment that fosters innovation, protects consumers, and ensures fair trade practices .

Additionally, the Liberia Telecommunications Authority (LTA) has undertaken market studies to assess competition in the telecommunications sector. These studies aim to identify anti-competitive behaviors and propose regulatory measures to prevent market failure, thereby promoting a healthy competitive landscape 

🔄 Future Outlook

Liberia is in the process of aligning its competition laws with regional standards to ensure a fair and competitive market environment. The establishment of a National Competition Authority and the enactment of comprehensive competition and consumer protection laws are pivotal steps toward achieving this goal.
