Defamation Credit Report Banking Consumer Dispute

Defamation via Credit Report - Banking Consumer Dispute

When bank reports you as defaulter to CIBIL/Experian/Equifax/CRIF and that report is false, it is both Deficiency in Service under Consumer Protection Act AND Defamation.

CIBIL report is accessed by every bank. One wrong entry = loan rejection, credit card limit cut, tender loss. Law calls it Civil Defamation + Reputational Injury.

1. Legal Framework - 3 Layers

A. Credit Information Companies (Regulation) Act, 2005 (CICRA)

  • Sec 17-21: Credit Information Companies (CIC) like TransUnion CIBIL can collect credit info only from member credit institutions (banks/NBFCs). Banks must ensure accuracy.
  • Sec 21: If borrower disputes info, CIC must resolve within 30 days after consulting bank.
  • Sec 22-25: RBI can impose penalty on CIC or bank for contravention. RBI may impose penalty for false entry.
  • Sec 30: Nothing in Act shall affect right of any person to claim damages against CIC, credit institution. So CICRA does NOT bar consumer forum or civil suit for defamation.

Madras High Court 2023 (8) TMI 342: Credit information furnished under CICRA, when supplied in accordance with statutory reporting scheme, does not by itself constitute defamation under Sec 500 IPC. Act provides self-contained mechanism for disclosure, correction, confidentiality, dispute resolution. But if reporting is false, outside statutory scheme, or after settlement, it IS defamation.

B. RBI Compensation Framework for Delayed Updation / Rectification - Circular RBI/2023-24/72 dated Oct 2023

  • 30 days rule: If dispute filed with bank or CIBIL, bank has 21 days to respond to CIBIL, CIBIL has 9 days to close - total 30 calendar days.
  • If not resolved in 30 days: Liable to pay Rs.100 per calendar day for every day delay to complainant, credited within 5 working days of resolution.
  • This is automatic - you don't need to prove loss for this Rs.100/day.

C. Consumer Protection Act 2019 + Law of Defamation

  • Wrongful reporting as defaulter = Deficiency in Service under Sec 2(11) + Unfair Trade Practice under Sec 2(47)
  • Also Defamation under Sec 499 IPC / Civil defamation - Publication to third party (CIBIL publishes to all banks) that you are defaulter, lowering your credit reputation.

2. When Does Wrong CIBIL Reporting Become Defamation?

3. Case Laws - Compensation Awarded

CASE 1: NCDRC - Standard Chartered Bank - Rs.2 Lakh for Spoiling Credit Record

NCDRC Order - Hanumesh Bandurao Kulkarni vs Standard Chartered Bank - Moneylife reporting

Facts: Vadodara-based Kulkarni paid all dues while closing credit card with StanChart, but was shown as defaulter in CIBIL report. Due to this his creditworthiness spoiled.

Held: NCDRC rapped StanChart for spoiling customer's credit record. State Commission + NCDRC upheld - Bank to pay compensation of Rs.2 lakh for negligence and reporting customer as defaulter to CIBIL.

Ratio: Once borrower pays full, bank must immediately update CIBIL. Failure = deficiency, bank liable for reputational loss.

CASE 2: Chandigarh District Consumer Commission - SBI Cards - Wrongful Reporting After Settlement = Deficiency + Unfair Trade Practice

Sanjay Singla vs SBI Cards & Payment Services Pvt Ltd - LiveLaw 2024

Facts: Complainant settled credit card dues fully. SBI Cards acknowledged receipt. Still reported as defaulter and transferred settled account to another bank.

Commission Held:

Reporting complainant as defaulter and transferring settled account despite receipt of full payment amounts to deficiency in service and unfair trade practice. Once borrower cleared all outstanding dues and creditor acknowledged same, account cannot be treated as defaulted account, nor can consumer's credit record be adversely affected.

Order: Remove name from CIBIL defaulters list + pay Rs.20,000 compensation for harassment + mental agony + litigation cost.

CASE 3: NCDRC - Doctor's CIBIL Score Dropped Due to Bank Fault - Rs.2.6 Lakh Damages After 7 Years

NCDRC Order dated 9 April 2024 - CIBIL score dropped due to bank's fault

Facts: Doctor complainant - outstanding amounts wrongly shown in credit card account, CIBIL rating badly affected, branded as defaulter, credit limit with American Express lowered.

Held: NCDRC observed: "It has been clearly established that outstanding amounts were wrongly shown in credit card account of Complainant, which adversely impacted his CIBIL score"

Order: Rs.2.6 lakh damages after 7-year battle. Compensation for credit limit lowered, mental agony, litigation.

Lesson: You can claim consequential loss - Amex lowered limit due to wrong CIBIL.

CASE 4: Finance Company Wrongly Reporting as Written Off Despite Settlement - Rs.40,000

District Consumer Forum - Indian Express Reporting

Finance company intimated CIBIL about status as written off despite loan accounts settled.

Held: Act of company in intimating CIBIL about status as written off despite fact that loan accounts were settled amounts to deficiency.

Order: Write to CIBIL to remove name + pay Rs.30,000 for mental agony + Rs.10,000 litigation.

CASE 5: SUPREME COURT LANDMARK - When Consumer Forum Has NO Jurisdiction - Commercial Loan

The Chief Manager, Central Bank of India vs M/s Ad Bureau Advertising Pvt Ltd - 2 S.C.R. 1445 : 2025 INSC 288 : 2025 LiveLaw (SC) 264 - Judgment dated 28 Feb 2025 by Justice Sudhanshu Dhulia & Justice Prashant Kumar Mishra[2025]

Facts:

  • Ad Bureau Advertising took project loan from Central Bank of India.
  • Bank accepted One-Time Settlement, issued No-Dues Certificate and filed full-satisfaction memo under RDDBFI Act before DRT.
  • Despite settlement, bank continued to classify and report borrower as defaulter to RBI/CIBIL under Master Circular on Wilful Defaulters, causing loss of reputation and forfeiture of Airports Authority of India advertising licence/tender.
  • NCDRC found deficiency and awarded Rs.75,00,000 compensation.

Supreme Court Held - Set Aside NCDRC Order:

  • Borrower taking loan for profit generation / commercial purpose is NOT consumer under Sec 2(1)(d)(ii) Consumer Protection Act 1986.
  • Project loan has close nexus with profit-generating activity, complaint not maintainable before NCDRC.
  • NCDRC order of Rs.75 lakh compensation set aside.

Ratio - Very Important for You:

  • If you are individual salaried, home loan, personal loan, credit card = You ARE consumer, you can go to consumer forum.
  • If you are company, LLP, firm taking business loan for profit = You are NOT consumer under new Act Sec 2(7) - commercial purpose exclusion. You must go to Civil Court for defamation suit, not consumer forum.

This judgment has overruled many NCDRC compensations for companies.

CASE 6: Citibank vs M.K. Sachdeva - Consumer Court Case 2022 - Credit Card CIBIL Defamation

Citibank credit card 5546-3791-5573-3007 issued 26.01.2005 limit Rs.60,000. Complainant claimed regular payments, bank placed name in defaulters list at CIBIL, name and reputation defamed to irreparable extent.

Issue: Forum examined whether reporting after payment dispute = defamation.

Held: If outstanding shown wrongly, bank liable.

4. Your Complete Legal Action Plan

Step 1: Collect Evidence

  • CIBIL report (less than 60 days old) showing wrong entry
  • NOC / Closure letter / Settlement letter / Statement showing zero
  • Rejection letter from HDFC/other bank citing CIBIL report - This proves consequential loss and defamation publication.

Step 2: File Dispute

  • File online dispute on CIBIL portal (MyCIBIL) - mark account as "Not mine" or "Amount incorrect" or "Account closed"
  • Simultaneously send legal notice to Bank Nodal Officer + Principal Nodal Officer under RBI Ombudsman - Attach proof, demand correction within 21 days and compensation for defamation.

Step 3: Wait 30 Days - Automatic Rs.100/day
If not resolved in 30 calendar days, you become entitled to Rs.100 per day under RBI Framework. After resolution, bank must credit within 5 working days. If not, file complaint to RBI Integrated Ombudsman under RB-IOS 2021 - Ground: Non-adherence to credit information reporting.

Step 4: File Case

  • If individual consumer: File Consumer Complaint under Sec 35 CPA 2019 before District Commission.
    • Prayers: Direction to bank to update CIBIL as Closed / Settled, Remove defaulter tag, Pay compensation Rs.2-5 lakhs for mental agony + defamation, Pay Rs.100/day RBI compensation, Litigation cost.
    • Cite NCDRC StanChart Rs.2 lakh, Chandigarh SBI Cards, NCDRC Doctor Rs.2.6 lakh cases.
  • If business entity: File Civil Suit for Defamation + Damages before Civil Court / Commercial Court under Sec 30 CICRA. Claim damages for loss of tender, loan rejection, reputational loss. Cite Supreme Court Ad Bureau case that civil suit is maintainable.

Step 5: Criminal?
If bank deliberately reports false info despite NOC, file complaint under Sec 23 CICRA (punishment for false entry) - imprisonment up to 1 year - and Sec 500 IPC defamation. But Madras HC says if reported in accordance with statutory scheme, no defamation. So criminal only in gross false cases.

Sample Compensation Claimed in Courts:

  • Rs.20,000 to Rs.2,00,000 for individual cases
  • Rs.75 lakh set aside by SC for commercial (now not maintainable in consumer forum)
  • Plus RBI Rs.100/day
