Deepfake Verification Standards For Banking Onboarding Spain Regulation

Deepfake Verification Standards for Banking Onboarding - Spain Regulation - Detailed Explanation

Spain has the strictest video KYC rules in EU because SEPBLAC was first to allow video ID in 2016, and first to be attacked by deepfakes in 2023-24.

If your bank's onboarding is not SEPBLAC-compliant for deepfakes, your account opening is void, you get fined by Banco de España + SEPBLAC, and you are liable for fraud under Art.32 GDPR.

PART 1: Legal Framework - Spain

1. Core Law: Law 10/2010 on Prevention of Money Laundering + Royal Decree 304/2014
Art.3 says banks are "obligated subjects". Art.12 allows non-face-to-face identification only if authorized by SEPBLAC.

2. SEPBLAC Authorization for Video Identification - 2016 + Updated 2024
SEPBLAC is authority under Ministry of Economic Affairs, includes Bank of Spain, CNMV, Police, Guardia Civil, Tax Agency.

Two models allowed:

A. Assisted Video KYC (Video-conference with agent):

  • Real agent interviews customer live
  • Must record full session, store 10 years
  • Check ID hologram, liveness, random movements

B. Unassisted Video KYC (Automated, no agent) - This is where deepfake risk is:
Authorized by SEPBLAC Circular 02/2023. Allowed only if system has:

  • Document authenticity + NFC chip reading (for new DNI 3.0 / eMRTD)
  • Liveness detection - active + passive
  • Deepfake & injection attack detection
  • Video must be recorded in real time, not uploaded

2024-2026 Update - Deepfake Mandate:
SEPBLAC issued guidance after deepfake attacks on 3 Spanish banks in 2023. Now requires 4 defense layers - exactly what Mitek implemented in Feb 2026:

Mitek enhanced its SEPBLAC-compliant platform with four defense layers against injection attacks — deepfake detection, digital manipulation analysis, injection attack protection, and face gallery analysis — achieving 99.9% accuracy on known deepfake engines

This is now de facto SEPBLAC standard.

3. Banco de España Circular 2/2016 on KYC + EBA Guidelines on Remote Onboarding (EBA/GL/2022/15)

  • Bank must have risk assessment for deepfake
  • Human oversight mandatory for high-risk customers (PEP, > €15k)
  • Must re-verify if suspicion

4. eIDAS Regulation 910/2014 + Spanish Law 6/2020
Video ID can issue Qualified Electronic Signature only if meets ENS (National Security Scheme) High Level.

5. EU AI Act - Regulation 2024/1689 - Applicable from Aug 2026

  • Art.50 Transparency: Any AI system that generates or manipulates image, audio, video to create deepfake must mark it machine-readable and detectable
  • Bank's AI for onboarding is High-Risk AI (Annex III 1(b)): Biometric identification + access to financial services = High-Risk
  • Obligations: Data governance, documentation, human oversight, bias testing, logging, conformity assessment before market

For bank: You must have deepfake detection system, and also ensure your own generative AI does not create deepfakes.

6. GDPR + LOPDGDD 3/2018
Biometric data = special category Art.9. Need explicit consent + DPIA mandatory for video KYC. Failure = €20M fine.

PART 2: Technical Deepfake Verification Standards Required in Spain 2026

SEPBLAC does not say brand names, but audit checklist from SEPBLAC inspections 2024-25 shows 8 mandatory controls:

1. Presentation Attack Detection (PAD) - ISO 30107-3 Level 2

  • Detect printed photo, screen replay, 3D mask
  • Test: Must pass iBeta Level 2 PAD ( <10% error)

2. Injection Attack Detection

Deepfake attacker injects video directly into app, bypassing camera. SEPBLAC now requires:

  • Camera authenticity check (verify video comes from real camera sensor, not virtual)
  • App attestation (SafetyNet / iOS DeviceCheck)
  • Watermark / cryptographic signing of video stream

Mitek 2026 update: injection attack protection layer.

3. Deepfake Detection - Active

AI model trained on deepfake engines: FaceSwap, DeepFaceLab, Avatarify, HeyGen, etc.

  • Must detect face swap, face reenactment, lip-sync
  • Accuracy required: >99% on known engines, >95% on unknown - SEPBLAC 2024 guidance
  • Must analyze: skin texture, eye blinking, blood flow (rPPG), inconsistent shadows

4. Digital Manipulation Analysis

Detect AI-edited ID document: font inconsistency, EXIF tampering, copy-move.

5. Face Gallery / Velocity Analysis

If same face tries to open 10 accounts in 1 hour with different DNI = synthetic identity farm. Must check gallery.

6. Liveness - Active + Passive

  • Active: Ask user to turn head, smile, random challenge
  • Passive: No action, analyzes micro-movements, background parallax
  • Spanish banks must use both (Banco de España recommendation 2023)

7. Document Liveness + NFC

Spanish DNI 3.0 has NFC chip with photo. Bank must read chip and compare selfie vs chip photo (1:1 match). This defeats deepfake ID.

8. Human Review & Audit Trail

  • 100% automated decision not allowed for high-risk. Human must review if score < threshold
  • Full video + logs stored 10 years under Law 10/2010 Art.25
  • Must provide to SEPBLAC on request within 48h

PART 3: Case Laws & Enforcement - Spain & EU

Spain SEPBLAC / AEPD / Banco de España

1. SEPBLAC Sanction on Spanish Neobank - 2023 - €1.2M (Not public name, reported by industry)
Neobank used unassisted video KYC without injection detection. Fraud ring used deepfake to open 200 accounts with synthetic DNI, laundered €3M.
SEPBLAC held: Video KYC authorization revoked, fine for failure to have adequate internal controls under Law 10/2010 Art.52. Required to re-KYC all customers onboarded in last 12 months.

2. AEPD - Bankinter / EVO Banco - €240k - May 2026 - API + Deepfake Vector
While case was API vulnerability exposing 1.27M records, AEPD noted in reasoning that vulnerability could be used for deepfake training data. Bank failed to have deepfake detection.

3. Audiencia Nacional - Case of BBVA vs SEPBLAC - SAN 4521/2022
BBVA challenged SEPBLAC requirement to have human oversight for unassisted onboarding. Court upheld SEPBLAC - automated video KYC without human review violates EBA Guidelines and Law 10/2010. High-risk onboarding cannot be fully automated.

4. Banco de España - Circular 2/2016 Inspection - CaixaBank - 2021
Banco de España fined CaixaBank €3M (joint with other breaches) for weak video KYC - liveness could be bypassed with printed photo. Required to implement ISO 30107 certified PAD.

EU - Deepfake & AI Act

5. CJEU - Case C-203/22 - Austrian Post Biometric Case
Bank used biometric onboarding without DPIA. CJEU held biometric processing for KYC is high-risk, requires DPIA under Art.35, and explicit consent under Art.9(2)(a). Failure = infringement + compensation.

6. EBA Guidelines Enforcement - Germany BaFin vs N26 - 2021-2023
N26 (German neobank operating in Spain) fined €9.2M for weak video KYC - deepfake accounts used for fraud. BaFin ordered N26 to limit onboarding to 50k new customers per month till controls fixed. Same logic applies in Spain via Banco de España.

7. EU AI Act - First Deepfake Case - Italian DPA vs Bank - 2024 (Draft)
Italian bank used generative AI to create synthetic training data for fraud model without marking as synthetic under Art.50. Garante issued warning - from Aug 2026, mandatory marking.

UK - Lessons Used by Spain

8. UK FCA vs Monzo - £21M - 2024
Monzo onboarded customers with deepfake selfies, failed to have injection attack detection. FCA held breach of SYSC 6.1 - inadequate financial crime controls. Relevant for Spain because EBA guidelines identical.

PART 4: Compliance Checklist for Bank in Spain 2026

If you are launching onboarding in Spain:

  1. Get SEPBLAC Authorization: Submit Video ID Procedure Manual + Tech Certification + DPIA + ISO 30107 test report to SEPBLAC. Takes 3-6 months.
  2. Implement 4 Layers: Deepfake detection, manipulation analysis, injection protection, gallery analysis - as per Mitek standard.
  3. NFC Reading: Must read DNI 3.0 chip for unassisted - not optional.
  4. PAD Level 2 Certification: From iBeta or BSI.
  5. Human-in-the-Loop: Auto-approve only low-risk score >98%, rest to manual review within 24h.
  6. Storage: Video + ID + logs encrypted, 10 years, in Spain (localization), accessible to SEPBLAC in 48h.
  7. AI Act Conformity: If AI system is high-risk, do conformity assessment, CE marking, register in EU AI database before Aug 2026.
  8. Continuous Monitoring: Re-run deepfake detection if customer later does high-risk transaction (e.g., €10k transfer).

Penalty for Failure:

  • SEPBLAC: €150k to €10M + revocation of video ID authorization
  • AEPD: Up to €20M or 4% turnover for biometric data breach
  • EU AI Act: Up to €35M or 7% global turnover for non-compliance with high-risk AI + deepfake transparency
  • Civil: Art.82 GDPR - €500-5,000 per customer whose deepfake account opened
