Paraguay has made significant strides in developing its cyber law framework, aligning with international standards and enhancing its capacity to combat cybercrime and protect personal data.

Paraguay's primary legal instrument for addressing cybercrime is Law No. 4.439/2011, which amends the Penal Code (Law No. 1.160/1997) to include specific provisions on computer-related offenses Key provisions include:

Article 146c:Addresses unauthorized interception of data

Article 174b:Pertains to unauthorized access to computer systems

Article 175b:Defines sabotage of computer systems

Article 248b:Concerns the forgery of debit or credit cards and other electronic means of payment, These amendments align Paraguay's legal framework with international standards, including the Budapest Convention on Cybercrime, to which Paraguay acceded in 2017.

Paraguay enacted Ley 5.542/2016, the Personal Data Protection Law, which establishes guidelines for the collection, processing, and storage of personal dat. The law empowers the National Authority for the Protection of Personal Data to enforce compliance and impose penalties for violation. Penalties can include fines, processing bans, and mandatory changes to processing activitie. In 2023, the Central Bank of Paraguay issued Resolution No. 3, regulating credit information bureaus and the protection of credit personal information, further strengthening data protection measure.
