Cyber Law at Kosovo

Kosovo has developed a comprehensive legal and institutional framework to address cybersecurity, aligning with European Union standards and international best practices. 

๐Ÿ›ก๏ธ Cybersecurity Legislation

 In February 2023, Kosovo's Assembly enacted Law No. 08/L-173 on Cyber Security, which  

- Establishes the Cyber Security Agency (ASK), responsible for overseeing national cybersecurity measures  

- Mandates that all digital service providers report cybersecurity incidents to ASK within 24 hours  

- Partially transposes EU directives 2013/40 and 2016/1148, focusing on the security of network and information systems  

๐Ÿ›๏ธ Institutional Developments

 To enhance cybersecurity capabilities, Kosovo ha:  

 Approved the establishment of the Cyber Security Agency, tasked with implementing cybersecurity measures and increasing national capacities.  

 Created a Cyber Security Training Centre within the Ministry of Dรฉfense and Kosovo Security Force, aimed at providing training for all Kosovo institutions in the field of cybersecurity.  

 Implemented a ban on the use of TikTok in state institutions to mitigate potential cybersecurity risk.  

โš–๏ธ Legal Reforms and Proposals

Cyber Violence Proposals have been made to include "gender-based cyber violence" in Kosovo's Penal Code, emphasizing the need for consistent definitions and penalties for online abus.  

Copyright Law  In October 2023, Kosovo adopted a new Law on Copyright and Related Rights, aligning with EU standards and expanding protection for copyright holders, particularly in the digital environment.

 Kosovo's legal framework for data protection is evolving   While the Information and Privacy Agency (AIP) oversees data protection, there have been instances where AIP was not involved in the drafting process of cybersecurity legislation, highlighting the need for improved coordination between institutions.

 Kosovo's cybersecurity laws are designed to align with EU directives, enhancing its capacity for cross-border cooperation in combating cybercrime and improving the security of information systems and networks.

 Kosovo has made significant progress in establishing a robust cybersecurity framework.   The enactment of comprehensive laws, establishment of dedicated agencies, and alignment with international standards demonstrate Kosovo's commitment to enhancing its cybersecurity posture.
