Cyber Law at Fiji

Fiji has developed a comprehensive legal and institutional framework to address cybercrime, online safety, and cybersecurity. Here's an overview of the key components:

Cybercrime Act 2021 Enacted in February 2021 and effective from November 2022 (except for Section 34), this Act aligns with the Budapest Convention on Cybercrime  It criminalizes various cyber offenses, including  

Unauthorized Access: Accessing computer systems without lawful authority 

Data Interference: Altering or destroying computer data 

Computer-Related Offenses: Forgery, extortion, and fraud involving computers 

Identity Theft: Stealing personal information for fraudulent purposes 

Telecommunication Theft: Illegally obtaining telecommunication services 

Evidence Admissibility: Accepting electronic evidence, such as social media screenshots, without traditional authentication  

Online Safety Act 2018 Established the Online Safety Commission (OSC) to promote responsible online behaviour and address harmful electronic communications  The Act criminalizes

Harmful Electronic Communications: Posting content that causes harm 

Intimate Visual Recordings: Distributing intimate images without consent

Cybercrime Unit, Fiji Police Force Specializes in investigating cybercrimes, with capabilities enhanced by a digital forensic laboratory established in 202  

Fiji CERT (Computer Emergency Response Team)  Established in 2024 to respond to cyber incidents and strengthen national cybersecurity efforts

 Fiji has been invited to accede to the Budapest Convention on Cybercrime, reflecting its commitment to international cooperation in combating cybercrime

 The government is developing a National Cybersecurity Strategy, informed by a Cybersecurity Maturity Model assessment conducted with the Oceania Cyber Security Centre.   This strategy aims to enhance national resilience against cyber threats
