Vicarious Liability in Tort

Vicarious liability in tort law refers to a legal doctrine that holds one party liable for the tortious acts of another, even if the first party did not commit the wrongful act themselves.

🔹 Definition

Vicarious liability typically applies in employer–employee relationships, where an employer may be held legally responsible for the wrongful acts (e.g. negligence, assault, etc.) of an employee if those acts were committed:

"In the course of employment"

🔹 Key Elements

Existence of a relationship
Usually employer–employee (not independent contractor).

Wrongful act committed
The employee committed a tort (e.g. negligence, defamation, battery).

Act occurred during the course of employment
The act must be closely connected with the employee’s duties or authorized tasks.

🔹 Justifications

Control theory: The employer controls how work is done, so should bear responsibility.

Risk distribution: Employers are in a better position to absorb or insure against losses.

Fairness: Victims should have a financially responsible party to sue.

🔹 Limiting Factors

Frolic and detour:
If an employee deviates substantially from their duties (a “frolic”), the employer might not be liable. A small deviation (a “detour”) may still result in vicarious liability.

Independent contractors:
Generally, employers aren’t liable for torts committed by independent contractors, except in limited situations (e.g. non-delegable duties or inherently dangerous activities).

🔸 Lister v Hesley Hall Ltd [2001] UKHL 22

Held: An employer was vicariously liable for sexual abuse committed by a warden because the abuse was closely connected with the employment duties, which gave the warden access to the children.
