Justice M.M. Sundresh, born on July 21, 1962, in Erode, Tamil Nadu, is a sitting judge of the Supreme Court of India, known for his deep expertise in criminal, civil, and constitutional law. He completed his B.A. at Loyola College, Chennai, and his law degree at Madras Law College. After enrolling as an advocate in 1985, he served as a government counsel for Tamil Nadu from 1991 to 1996, representing the state and various corporations in a wide spectrum of legal matters.
Justice Sundresh was appointed as an Additional Judge of the Madras High Court in 2009 and became a permanent judge in 2011. During his 12-year tenure at the Madras High Court, he disposed of over 1,03,000 cases, reflecting his efficiency and commitment to judicial work. He also served as President of the Tamil Nadu State Judicial Academy before his elevation to the Supreme Court on August 31, 2021.
At the Supreme Court, Justice Sundresh has authored 28 judgments and participated in over 200 benches as of early 2025. His work predominantly covers criminal law (58%), followed by property, civil, constitutional, and service matters.
Landmark Judgments
CCI v. State of Mizoram (2022):
Justice Sundresh played a pivotal role in this judgment, which clarified the jurisdiction of the Competition Commission of India (CCI) over state actions. The Supreme Court, with Justice Sundresh on the bench, held that the CCI has the authority to investigate anti-competitive practices even when state governments are involved, reinforcing the autonomy and reach of regulatory bodies in India.
Nuruddin v. State of U.P. (2023):
In this significant criminal law case, Justice Sundresh addressed the rights of the accused and the importance of fair investigation. The judgment emphasized due process and the need for the state to ensure impartiality and transparency in criminal investigations, thereby strengthening procedural safeguards for individuals.
