Juvenile Laws at Zimbabwe

Zimbabwe has been actively reforming its juvenile justice system to align with international standards and prioritize the rights and rehabilitation of children in conflict with the law. 

โš–๏ธ Age of Criminal Responsibility

Current Legal Framework: Under the existing Criminal Law (Codification and Reform) Act (Chapter 9:23), the age of criminal responsibility is set at 7 years, with a rebuttable presumption of criminal capacity for children aged 7 to under 14. This means children in this age bracket can be presumed capable of committing crimes unless proven otherwise. 

Proposed Reforms: The government has approved principles to raise the minimum age of criminal responsibility from 7 to 12 years. This change aims to better protect children's rights and align with contemporary understanding of child development.

Child Justice Bill: The Child Justice Bill seeks to create a separate justice system for children, emphasizing restorative justice and rehabilitation Key provisions include: 

Child Justice Courts: Establishment of specialized courts with trained personnel to handle cases involving children These courts would focus on diversionary measures and rehabilitation rather than punitive approaches 

Diversion Programs: Implementation of diversion options to redirect children from the formal justice system, focusing on restorative justice practices

Corporal Punishment In April 2019, Zimbabwe's Constitutional Court ruled that corporal punishment for juvenile offenders is unconstitutional, deeming it inhuman and degrading.  This decision aligns with international human rights standards prohibiting such practice.  ๎ˆ€cite๎ˆ‚turn0search1๎ˆ 

Pre-Trial Diversion Program Launched in 2013, this program has successfully diverted a significant number of children from the formal justice system.  It offers counselling, victim-offender mediation, and other rehabilitative services to prevent recidivism.
