⚖️ Legal Framework

Minimum Age of Criminal Responsibility: In Sint Maarten, individuals aged 12 and older can be prosecuted for offenses. For those under 12, if their behavior is deemed seriously deviant, civil measures such as mandatory treatment or placement may be considered. 

Sentencing and Rehabilitation: For minors aged 12 to 16, sentences can be up to 12 months, while those aged 16 to 18 may face sentences up to 24 months. Emphasis is placed on rehabilitation, with alternatives like community service, training orders, or reparations being common. Programs such as HALT and STOP are employed to address juvenile delinquency through rehabilitative and restorative justice approaches. 

🏛 Juvenile Justice System

Youth Case Consultation:Each month, the Public Prosecutor, Police Force, and Trusteeship Council convene to discuss juvenile cases, including issues like school absenteeism, to determine appropriate interventions.

Miss Lalie Center:This juvenile detention facility houses minors in conflict with the law. However, concerns have been raised regarding the adequacy of educational programs and overall conditions at the center. The Law Enforcement Council has noted that while some recommendations have been implemented, significant improvements are still needed.

Conditional Discharge and HALT Settlements For less serious offenses, minors may receive a conditional discharge, which includes attending training, performing community service, or following juvenile probation instruction. HALT settlements involve attending a short course or completing a limited number of service hour.

Mediation and Reintegration Programs The Stichting Justitiële Instellingen Sint Maarten (SJIB) offers psycho-social support and mediation services aimed at reducing re-offending and facilitating the reintegration of offenders into the community.
