Family Law in Denmark

Marriage

To marry in Denmark, couples must obtain a certificate of marital status (prøvelsesattest), confirming they meet the legal requirements set out in the Danish Act on the Formation and Dissolution of Marriage. Applications for this certificate are processed by the Agency of Family Law or local municipalities, depending on the individuals' nationalities and residency status. 

Divorce and Separation

Denmark's family law encompasses legal separation and divorce proceedings. The Agency of Family Law oversees cases concerning child custody, residence, and access, while divorce proceedings may involve both the Agency and the courts, depending on the specifics of the case. 

Child Custody and Access

All cases concerning child custody, residence, and access in Denmark initiate with the Agency of Family Law. They handle applications related to the child's welfare, including situations involving international child abduction. 

Adoption

Adoption laws in Denmark have evolved to allow same-sex couples to jointly adopt children, both domestically and internationally. Since 2010, same-sex couples have had the legal right to apply jointly for adoption, reflecting Denmark's progressive stance on LGBTQ+ rights within family law. 

Recent Developments

In a significant policy shift, Denmark has decided to discontinue the use of "parenting competency" tests for Greenlandic families. These tests were previously criticized for cultural insensitivity and their role in the separation of children from their families. The government acknowledged that these assessments did not adequately consider cultural differences and has pledged to replace them with a unit possessing cultural expertise.
