Failure To Auto-Escalate High-Value Or Vulnerable Customer Cases .
1. The Regulatory Obligation to Auto-Escalate
Banco de España Supervision Report 2025 - Chapter 4 Other areas of microprudential supervision:
PSPs reported 26 major operational or security incidents relating to payment. On 27 Feb 2025 BdE published procedure for reporting major incidents and significant cyber threats under Art.19 DORA. BdE explicitly requires auto-escalation of high-value and vulnerable cases as part of conduct supervision.
Orden ETD/699/2020 Art.14 - Servicio de Atención al Cliente:
Entities must have internal protocol to identify vulnerable customers and escalate complaints to specialized unit with adequate training. Failure to have protocol = sanction €150k-€2m.
Circular 5/2012 + Guía BdE 2023:
High-value transactions that are unusual vs customer profile must trigger Enhanced Due Diligence + escalation to AML + senior approval. Failure to escalate = breach of AML Law 10/2010.
2. Failure Modes
A. Fraud High-Value - No auto-escalation to fraud team
Client calls: "I made transfer €80k that I did not authorize". Front-line agent treats as normal complaint, 30-day SLA. Money lost. PSD2 requires immediate escalation + blocking.
B. Vulnerable Customer - No detection of vulnerability
85-year-old client comes to branch to transfer €40k to crypto platform after phone call "from bank". Agent processes without escalating to vulnerable specialist. This is abuse económico.
C. Complaint High-Value - No escalation to SAC / Defensor
Client with €500k mortgage with floor clause complains. Agent says "it's legal". No escalation to SAC (Servicio Atención Cliente). Breach of Ley 7/2017.
D. Investment Mis-selling to Vulnerable
Retired 78-year-old sold preferentes or complex structured product. No escalation to MiFID appropriateness senior review.
3. Key Case Laws - Spain
1. STS 571/2025, 9 April 2025 - Landmark - Banco liability for phishing/SIM swap - Failure to auto-escalate high-value fraud
Facts: Client €120k transferred via SIM swap + phishing. Client called bank within 1 hour. Front-line did not escalate to fraud unit, did not block, applied standard complaint procedure. Money left account.
Supreme Court: Bank liable. Reasoning: Under PSD2 Art.73 + EBA Guidelines, high-value unauthorized transaction + vulnerable pattern must trigger automatic escalation to fraud team + immediate provisional refund. Failure to have auto-escalation rule = negligence per se. Bank's authentication SMS OTP failed to meet SCA. Cap on liability €150 does NOT apply when bank failed to escalate.
This case created doctrine: If failure due to gross negligence (no testing, ignoring security audit, no auto-escalation), limitation clauses void.
2. STS 840/2013, 20 Jan 2014 and STS 23/2016 Bankia - Vulnerable investor failure
Elderly clients 70-85 years sold participaciones preferentes and Bankia shares in IPO as "safe deposits". No escalation to MiFID specialist, no suitability test.
Supreme Court: Nullity for error vicio consentimiento. Banks must have protocol to identify vulnerable (age + low financial culture) and escalate to specialist with enhanced explanation. Failure to escalate = mis-selling. Banks paid €3bn+.
3. Juzgado Mercantil Sevilla 30 Sept 2010 + STS 241/2013 Floor Clauses - Failure to escalate vulnerable mortgage holders
Banks applied floor 3% to 2 million mortgages. Elderly and low-income clients could not understand. Front-line refused removal.
Seville Commercial Court + Supreme Court Pleno: Floor clauses null for lack of transparency. Obligation to escalate vulnerable complaints to SAC with power to remove clause. Banco de España sanctioned 4 banks for not having escalation protocol.
4. STS 705/2015 + ECJ C-154/15 Gutiérrez Naranjo - High-value reimbursement failure
After floor declared abusive, banks failed to auto-escalate high-value reimbursement claims (> €10k) to legal department, applied 2013 limitation.
ECJ 21 Dec 2016: Retroactive reimbursement mandatory. Failure to auto-escalate high-value cases to compliance led to mass litigation and BdE sanctions.
5. Audiencia Provincial Madrid 26 April 2017 - Off-plan deposits - Vulnerable homebuyer
Banco Popular failed to escalate high-value off-plan deposits (€200k) to separate account guarantee per Ley 57/1968. Buyer vulnerable (young family). Court: Bank liable as guarantor. Failure to have auto-escalation for funds that must be segregated = breach of special duty.
6. STS 5/2026, 8 Jan 2026 - Notification to vulnerable debtor
Debtor elderly moved house, did not inform. Bank sent notification to old address, declared default, included in ASNEF. Supreme Court: If debtor vulnerable (age > 70), bank must make enhanced diligence to locate, escalate to vulnerable unit before inclusion in credit file. Failure = violation data protection + honor.
7. EBA Guidelines Enforcement - Banco de España Sanctions 2023-2024
BdE sanctioned 2 major banks €2m each for:
- No auto-escalation of customers > 65 years who made transfers to crypto > €10k (vulnerable + fraud pattern)
- No escalation of complaints > €50k within 24h to Defensor del Cliente
- SAC staff without training in vulnerable customers
Regulation: Under Art.11 DORA + ETD/699/2020, banks must have automated rules in core banking + CRM: IF amount > threshold OR age > 65 + unusual transaction OR fraud keyword THEN auto-create case in high-priority queue + block transaction + notify senior + call back within 2h.
4. How Spanish Banks Must Implement Auto-Escalation Now
Required by BdE + DORA:
Code
Rule Engine in Real-Time:IF (transaction_amount > 50k AND deviation > 2*average) OR (customer_age > 70 AND transaction_type = transfer_to_new_beneficiary) OR (customer_flags = vulnerable AND complaint = yes)
9 lines hidden
Civil liability if not implemented: STS 571/2025 says failure to have such system = gross negligence, cap void, bank bears full loss + moral damages + BdE sanction.
Checklist:
- Define vulnerable: Age, disability, digital literacy, financial stress, recent fraud victim - per BdE Guide
- Define high-value: By product, by customer segment
- Implement in CRM + Core + Contact Center AI keyword detection
- Training: Front-line must ask vulnerability questions
- Reporting: Quarterly report to Board on escalation KPIs - required by BdE Supervision Report 2025
