Expert Testimony In Financial Cases .
I. Legal Framework
India - Sec 45 Indian Evidence Act / Sec 39 Bharatiya Sakshya Adhiniyam:
When court has to form opinion upon point of foreign law, science, art, or identity of handwriting/finger impression, opinion of persons specially skilled is relevant fact. Under Indian Evidence Act, forensic audit results can be used in court. Section 45 allows forensic accountants to testify in fraud proceedings as expert witnesses.
Financial expert is "specially skilled" in:
- Banking operations, lending practices, regulatory compliance
- Forensic accounting, valuation, securities fraud
US - Daubert v. Merrell Dow Pharmaceuticals, Inc., 113 U.S. 2786 (1993) + Kumho Tire Co. v. Carmichael, 526 U.S. 137 (1999):
In 1993, Daubert established two-pronged test for admissibility. First, is reasoning or methodology underlying testimony scientifically valid? Second, can methodology properly be applied to facts? In other words, methodology must be 1) reliable, and 2) relevant.
In 1999, Kumho Tire extended scope of Daubert beyond scientific testimony to other financial experts, including accountants, economists and business valuers.
Daubert 4 factors for reliability:
- Testing - can theory be tested, has it been tested?
- Peer review - has theory been subjected to peer review?
- Error rate - known error rate?
- General acceptance
If too great analytical gap between data and opinion offered, exclude - General Electric Co. v. Joiner, Target case where expert report projecting $1.4M profits based on speculation excluded.
II. Types of Financial Expert Witnesses

- What constitutes fraud vs irregularity
2. Business Appraiser / Valuation Expert:

In civil financial cases involving following money - deposits or disbursements - through bank and brokerage accounts, expert provided with legal documents, discovery documents (bank, brokerage statements, credit card statements), admissions, deposition testimonies. Prepares detailed analyses of bank, brokerage, credit card records, income tax returns, contracts.
Crucial in Satyam scam, PNB fraud, Nirav Modi case in India have shown importance of forensic accounting.
III. Case Laws - India
1. Satyam Computer Services Scam - SEBI & CBI Cases (2009-2015) - Forensic Expert Reliance
- Expert: Forensic accountants from Grant Thornton + SFIO experts testified on inflated cash balances Rs.7,136 cr, ghost employees.
- Court Acceptance: Hyderabad Court accepted expert testimony that bank statements were forged using Photoshop + normal bank reconciliation not done. Conviction based on expert tracing of funds through bank accounts. Established that expert witness banking professional is guiding light in complicated web of financial disputes.
2. PNB Fraud - Nirav Modi - LoU Case - CBI vs Nirav Modi (2018 onwards)
- Expert: RBI former Deputy Governor + PNB SWIFT expert testified that LoUs issued without approval, bypassing CBS, no Nostro reconciliation.
- Issue: Was it fraud or operational lapse? Expert explained normal operating procedure: LoU requires 100% margin, approval in CBS, SWIFT messages must be matched with CBS. Deviation = fraud.
- Court: Accepted expert testimony under Sec 45 to prove dishonest intention under Sec 420/406 IPC.
3. Expert Report Not Cited as Witness Not Fatal at Discharge Stage - CRR 541 of 2025 (Bolpur)
Prosecution case centered on post-signature alteration/addition to receipts amounting to forgery. Court rejected contention that expert report could not be proved because expert not cited as witness at discharge stage. Held: Expert report can be proved at trial even if not cited earlier. For financial cases, handwriting expert report on cheque alteration can be admitted.
4. Suresh Saluja @ Pappy Saluja v. Special Director, ED - SAFEMA 2024 - Forex Manipulation - 165 taxmann.com 56
Exporter made bogus purported exports of sub-standard goods to Russia with inflated invoices to obtain export benefits under Duty Drawback, export proceeds sent through illegally acquired foreign exchange deposited in different bank accounts. Appellant prayed for cross-examination of witnesses. Court denied cross-examination as statements backed by documentary evidence (bank statements, shipping bills) and expert forensic audit of export value. Shows expert evidence + documents can outweigh need for cross-examination.
5. Onus To Prove Transaction Fictitious - SC - Justice Hemant Gupta & V Ramasubramanian
Two-judge Bench held person who alleges transaction is sham, bogus or fictitious must also prove same as onus lies on him. Relied on Subhra Mukherjee v. Bharat Coking Coal Ltd. In financial cases, party alleging evergreening or round-tripping must bring expert to prove sham nature through fund flow analysis. Mere allegation not enough.
6. HC Sends Disputed Cheque to Handwriting Expert for Fair Trial - Shashikant Patel vs State of Gujarat
Applicant disputed age of ink on cheque, prayed for comparison of ink used for text. Trial Court directed to send disputed cheque to FSL for opinion of handwriting expert as prayed in Exhibit-32. In banking fraud, cheque forgery cases, expert is mandatory.
IV. Case Laws - US / International (Applied in Indian Courts)
1. Daubert Challenge to Business Valuation Expert - iGames Entertainment v. Chex Services, C.A. No. 04-180-KAJ (D.Del. 2005)
Present opinion pertains to plaintiff's Daubert motion seeking to exclude part of proposed expert testimony of defendants' expert. Expert intended to testify on accounting matters. Court granted motion holding challenged parts failed test of relevancy. Court examined experts intended opinion under FRE 702. Principle: Banking expert cannot testify on legal conclusion - e.g., "bank committed fraud" - only on facts: "bank did not follow normal practice of verifying title". Ultimate issue left to judge.
2. Andrew J. Whelan et al. v. Tyler Abell - D.C. 1987 - Financial Valuation Expert Excluded
Judge excluded financial valuation expert testimony because methodology not tested, no peer review. Used in India to argue against arbitrary valuation in oppression cases - NCLT requires DCF with market comparables, not guess.
3. UAE Federal Decree-Law No. 21 of 2022 - Banking Expert Witness Framework
Expert witnesses in UAE operate under law setting out appointment, conduct, reporting obligations. Banking expert is individual with extensive experience, called upon to provide impartial, independent opinion on banking matters, rather than opinion favoring either party. Indian courts cite this for impartiality - expert must be independent, not hired gun. As per American Bar Association guidelines, experts must ensure testimony remains free from bias and personal interest.
V. How to Qualify & Use Expert in Indian Banking Court
For Bank / Prosecution:
- Selection: Former RBI Executive Director, former banker with 20+ years in credit, CA with forensic certification, SEBI registered valuer.
- Report Must Contain (per Order 26 CPC + Sec 45):
- Qualifications, independence declaration
- Documents examined - bank statements, loan file, CBS logs, SWIFT, Title Search Report
- Detailed analyses of bank records
- Methodology - e.g., fund tracing: Entry in account A -> RTGS to account B -> cash withdrawal
- Opinion: Whether transaction was in accordance with normal banking practice as per RBI Master Directions
- No legal conclusion - cannot say "accused guilty", can say "procedure violated"
- Admissibility Test (Indian Daubert-like):
- Is expert specially skilled? (Sec 45)
- Is methodology reliable? (peer reviewed - e.g., ICAI forensic accounting standards)
- Is it relevant? (helps judge understand banking operation)
- Is it unbiased?
For Defence - How to Challenge:
- File Daubert-like application under Sec 45 - methodology not tested, no error rate
- Show expert is interested (e.g., hired by bank, fee contingent)
- Show expert gave legal opinion, not factual
Example - Loan Fraud Defence:
Bank expert says loan given without title search is fraud. Defence expert says: In banking industry, 7-year search is normal for small housing loans per industry practice (cite Abbey National memo on statistical provisioning based on experience). Failure is irregularity, not fraud requiring mens rea.
