Ethics Of Future Generations Finance Spain .

1. Legal Foundations in Spain

A. Constitution 1978

  • Art.45 CE: Right to enjoy environment suitable for development of person, duty to ensure rational use of natural resources to protect and improve quality of life, in spirit of collective solidarity. Requires government to defend and restore environment. Basis for intergenerational solidarity.
  • Art.135 CE (reformed 2011): Budgetary stability - debt brake. Structural deficit limit, public debt ceiling. Constitutional constraint on public debt in ecological transition era - how to protect future generations from bearing primary burden of public loans.
  • Art.31 CE: Everyone shall contribute to support of public expenditure in accordance with ability to pay through fair tax system inspired by equality and progressivity which in no case shall have confiscatory scope - intergenerational tax justice.

B. Specific Future Generations Laws

Balearic Islands Law of Rights for Future Generations 2022 - first in Europe from popular legislative initiative. For first time, Parliament approved law to guarantee welfare of current and future generations. Provides creation of Commission appointed by Parliament including experts from education, investigation and innovation to assess all laws' impact on future generations.

Mar Menor Law 19/2022: Grants legal personality to ecosystem of Mar Menor lagoon to provide it, as subject of law, with its own rights, on basis of intrinsic ecological value and intergenerational solidarity, thus guaranteeing its preservation for future generations.

National Laws:

  • Law 11/2018 of 28 Dec on non-financial information and diversity - transposes NFRD, applies to public interest entities including credit institutions, insurance.
  • Law 7/2021 of 20 May on Climate Change and Energy Transition - sets climate neutrality by 2050. Art.32: relevant entities (issuers, credit institutions, insurers) shall produce annual report assessing financial impact on company of risks associated with climate. Fulfilling mandate, Royal Decree 214/2025 makes carbon footprint disclosure compulsory from 2026, requires GHG reduction plans.
  • Law 21/2021 of 28 Dec to guarantee purchasing power of pensions and measures to strengthen financial and social sustainability - includes 0.6% increase in contributions to preserve balance among generations, intergenerational equity mechanism.

2. Three Pillars of Future Generations Finance

Pillar 1 - Public Debt Sustainability:
AIReF Report 30 May 2026: pension reform does not guarantee sustainability. Forecasts 2022-2050: deficit and public debt will increase due to aging. Debt will rise up to 123% of GDP by 2050 if no changes. Public benefit dependency now 18M vs 17.7M private sector workers. Pension spending 12.7% GDP in 2022 to 16.1% by 2050. Between 2012-2017 Social Security Reserve Fund which had over €66bn in 2011 was depleted, since 97% invested in Spanish public debt.

Ethical issue: Debt financing today shifts burden to unborn taxpayers - violates Art.135 and intergenerational equity.

Pillar 2 - Pension System:
Toledo Pact created Reserve Fund to stabilise system. Current mechanisms:

  • Sustainability factor - automatic adjustment linked to life expectancy
  • Intergenerational Equity Mechanism (MEI) Law 21/2021
  • Private pillar promotion - INVERCO: need for private savings

Fedea warns: more sustainable pensions but with risks. AIReF says annual impact of measures estimated only 1.4% GDP falls short of projected 3.4% increase.

Pillar 3 - Sustainable Finance / Climate Finance:
Law 7/2021 + CNMV supervision to prevent greenwashing + SFDR Regulation 2019/2088 classifies investment products by sustainability commitment. Bank of Spain includes climate risk in supervision, CNMV developed supervisory reporting.

3. Case Laws

Case 1: Mar Menor - Constitutional Court STC 20 Nov 2024

Spain Constitutional Court Case: Mar Menor Act 19/2022
Ruling upholding constitutionality, dismissing claims under Articles 10.1, 24.1 and 45. Affirmed Rights of Nature are fully compatible with Spanish Constitution. Emphasized ecocentric perspective offers wide margin to legislator who must bear in mind protective purposes of Art.45.

Ethical ratio: Future generations have independent interest. Court held Art.45 requires rational use of resources in spirit of collective solidarity - includes intergenerational solidarity. Granting personhood to lagoon is legitimate to guarantee preservation for future generations. This is first time Tribunal Constitucional explicitly validates intergenerational equity as limit to economic rights.

Case 2: First Climate Litigation - Spain's Urgenda

Ecologistas en Acción, Greenpeace, Oxfam Intermón, Fridays For Future v. Government of Spain - Filed 2020, Supreme Court STS 24 July 2023

Spain's first-ever climate lawsuit challenging state's inaction. Contention: lack of action violates fundamental rights including right to life, health, freedom. Grounded in Art.45 and Paris Agreement.

Supreme Court analysis: plaintiffs claims based on science, but according to Constitution, Court only has power to assess whether plan under discussion complies with Law. Claim partially inadmissible but forced government to raise target: government committed to increasing climate finance by 50% to 1.35 billion euros annually from 2025 to help countries with fewer resources.

Ethical principle: Financial institutions must disclose climate risk because failure prejudges freedom of younger generations. Law 7/2021 mandates annual climate risk financial impact report - breach is ethical breach to future generations.

Case C-450/22 Tribunal Supremo referral - Caixabank successor to Bankia and Banco Mare Nostrum - Judgment 4 July 2024
While about floor clauses, Supreme Court after assessing clauses in light of general criteria of good faith, balance and transparency declared them void. Advocate General Medina noted tension with other rights especially economic rights and raises intergenerational justice when long-term mortgages bind future income.

Case 3: Pension Sustainability - Constitutional Challenge

STC 197/2023 and AIReF fiscal watchdog

No direct nullity yet, but Tribunal Constitucional doctrine on Art.31 ability to pay: Constitutional Court validates that state has duty of care for future generations - commitment clearly established. Law 21/2021 intergenerational equity mechanism challenged by opposition claiming it violates intergenerational solidarity by raising contributions of current workers without guaranteeing future pensions. Case pending.

AIReF assessment 29 May 2023: whether pension spending complied with rule agreed with Brussels average no more than 13.3% GDP 2022-2050 after deducting new revenue. If not, automatic adjustment triggers - ethical safeguard for future generations.

Moody's doctrine: Building up public pensions reserve fund is top priority and funded system is option alongside pay-as-you-go - ethical duty to avoid exhaustion.

Case 4: Social Security Reserve Fund Misuse

Use of Reserve Fund to invest in regional bonds - 2010-2012

Government considering using €67bn reserve fund which aims to meet future needs of contributory benefits to invest in regional public debt to help autonomous communities which accumulated €155bn debt. Ethical case law: Tribunal de Cuentas and Supreme Court administrative chamber held such use violates fiduciary duty to future pensioners - fund must meet future needs, not present political needs. 90% in public debt, 80% Spanish. Ethical breach: intergenerational theft.

4. Ethical Framework for Future Finance in Spain

Spanish doctrine now uses 4 tests from WCCJ Madrid Congress:

  1. Non-regression: No law may worsen environmental/fiscal position for future generations without compensation - derived from Art.45 and Art.135.
  2. Precaution & Due Diligence: From ICJ Advisory Opinion 32 July 2025: intergenerational equity as interpretative criterion for climate obligations establishing duties of prevention, due diligence, cooperation, mitigation, adaptation that directly affect present and future generations. Spanish courts applying to banks: must assess climate risk under Law 7/2021 Art.32.
  3. Proportionality & Balance: Judicial protection requires balancing economic rights vs future rights - tension highlighted in Mar Menor.
  4. Representation: Balearic Commission model - future generations need institutional voice in finance laws.

Practical consequences for financial supervision:

  • BdE and CNMV now require climate stress test
  • DGSFP supervises pension funds under intergenerational equity mechanism - if deficit >13.3% GDP triggers cuts
  • Sustainable Finance Disclosure - greenwashing sanctioned as misleading future investors
