Environmental laws at Sint Eustatius (Netherlands)

Sint Eustatius, one of the Caribbean Netherlands' BES islands, has implemented a robust legal framework to protect its unique natural environment. Key components of this framework include:

Marine and National Parks:

Statia National Marine Park: Established in 2001, this park covers the sea floor and overlying waters around the island, from the high water mark to the 30-meter depth contour. It includes two reserves where fishing and anchoring are prohibited to preserve marine life. 

Quill/Boven National Park: Declared in 2000, this park encompasses vital natural landscapes such as the Quill volcano and surrounding hilly areas. Activities like damaging, destroying, or altering these areas are prohibited to maintain their ecological integrity. 

Flora and Fauna Protection:

Strict regulations are in place to protect native species, including the 'Statia Morning Glory' and native iguana. Activities that harm or disturb these species are forbidden. 

Sea turtles are protected under international conventions, prohibiting their capture, possession, or trade, along with their eggs, parts, or products. 

Environmental Regulations for Businesses:

As of April 1, 2024, new environmental regulations have been enforced under the Establishments and Activities Decree BES (IAB BES) and the accompanying Ministerial Regulation (RIA BES). These regulations categorize businesses based on their environmental impact, ranging from Type I (low impact) to Type IV (high impact), each subject to specific rules and permit requirements. 

Type III and IV establishments, which have a greater environmental impact, are required to obtain environmental permits. For example, businesses like stone crushers, large-scale farms, and asphalt plants fall into these categories. 

Recent Developments:

In June 2022, the Public Entity St. Eustatius and the Ministry of Infrastructure and Water Management signed a letter of intent to collaborate on implementing environmental legislation effectively. This partnership aims to ensure that businesses comply with environmental standards, contributing to sustainable economic growth on the island..

These measures underscore Sint Eustatius's dedication to environmental preservation, balancing development with the protection of its rich natural heritage.
