Enforcement Attachment Orders .
PART 1: INDIAN LAW - CPC Order 21
What is Attachment?
Under Sec 51(b) CPC - Court may enforce decree by attachment and sale of property.
Attachment order = Court order prohibiting judgment-debtor (JD) from transferring, charging property, and prohibiting all persons from taking benefit from such transfer. [Order 21 Rule 54 for immovable, Rule 43 for movable]
Effects:
- Creates no charge, but Sec 64 CPC voids private transfer during attachment
- Property remains in JD's possession but under custody of law
- If JD transfers after attachment - transfer void against decree-holder (DH)
Types of Attachment Orders
1. Movable Property - Order 21 Rule 43-50:
- Actual seizure by bailiff, or
- Attachment of agricultural produce, debt, share
- Attachment of salary - Order 21 Rule 48 - up to 1/3rd of salary can be attached, not less than Rs 1000 + 2/3 must remain
2. Immovable Property - Order 21 Rule 54:
- Order prohibiting JD from transferring, and prohibiting others from taking benefit
- Proclamation by beat of drum, affixation on property
- No physical possession - only prohibitory order
- Must be entered in Encumbrance register
3. Attachment of Debt / Garnishee - Order 21 Rule 46, 46A - Third Party Debt Order:
- Debt due to JD from third party (Garnishee) - e.g. bank balance, rent
- Procedure: First attach debt under Rule 46, then issue Garnishee order under Rule 46A directing garnishee to pay to court
- Supreme Court in Executive Engineer, KSEB Board v J H Sharma AIR 1988 Ker 285 and Bhagyoday Cooperative Bank Ltd v Ravindra Patel 2022 INSC 1210 held: Execution court must first attach debt under Rule 46 before proceeding against garnishee under 46A. If direct 46A without 46, garnishee can challenge under Rule 58. Must follow Order 21 Rule 52 procedure.
4. Attachment before Judgment - Order 38 Rule 5-13:
- Secures future decree - plaintiff shows defendant about to dispose property to obstruct decree
Procedure
- DH files execution petition under Order 21 Rule 10
- Court issues notice to JD under Rule 22 if execution after 2 years
- Attachment order - Rule 54
- Objections under Rule 58 - third party claim that property not liable to attachment
- Sale - Rule 64 onwards
Case Laws - Supreme Court
Case 1: Ambati Narasayya v M Subba Rao AIR 1990 SC 119 - Mandatory Sale of Only Part
Supreme Court held Executing court has duty, not merely option, to consider selling only so much attached property as necessary to satisfy decree under Order 21 Rule 64. Sale of whole property without considering practicable partial sale violates Rule 64 and is voidable.
Example: Decree Rs 2 lakh, attached property worth Rs 50 lakh - cannot sell whole, must sell portion worth Rs 2-3 lakh only.
This is most cited case for attachment orders - protects JD from excessive sale.
Case 2: Nancy John Lyndon v Prabhati Lal Chowdhury - Sec 64 Void Transfer
Court scrutinized Sec 64 CPC - any private transfer during attachment is void. JD sold attached house during attachment. Purchaser claimed bona fide. Court held: Once attachment order passed, subsequent transfer void against DH, even if purchaser unaware. Encumbrance register notice is deemed notice.
Case 3: Sol Infotech Pvt Ltd v... (2001) 1 PLJR 134 - SC on Order 21 Rule 57 - Determination of Attachment
Rule 57: Where property attached and execution dismissed for default, court must specify whether attachment continues. If court dismisses execution without order on attachment, attachment deemed to cease.
SC held: Dismissal of execution petition without express order continuing attachment = attachment automatically vacated. Subsequent purchaser after dismissal gets good title.
Case 4: N Mohana Kumar v Bayani Lakshmi Narasimhaiah 17 Dec 1999
Fresh attachment order under Rule 54 not necessary if property already attached in previous execution of same decree. Attachment continues. Court shall attach by prohibitory order.
Case 5: Rajnesh v Neha (2021) 2 SCC 324 + Sunita Kachwaha v Anil Kachwaha (2014) - Maintenance Attachment
SC held for enforcement of maintenance orders, court can issue attachment of salary or property under Sec 125(3) CrPC. Mere earning of wife not ground to deny. Attachment of salary is valid enforcement - up to 1/3rd.
Case 6: Bhagyoday Cooperative Bank Ltd v Ravindra Patel 2022 INSC 1210 - Cooperative Decree Execution
SC directed execution of cooperative society decree must adhere to Order 21 Rule 52 - proper attachment procedures and safeguarding rights of garnishees. Cooperative court cannot bypass CPC.
PART 2: UK / ENGLISH LAW - Freezing vs Attachment vs Third Party Debt Orders
Difference:
- Attachment orders (Civil law + Scotland/US): Operate against specific assets - take control, place in custody of court/sheriff. Proprietary effect.
- Freezing injunctions (Mareva injunction) - CPR 25: Operate in personam against respondent - restrain respondent from dealing with assets up to value. Does NOT give claimant proprietary right. Assets remain with respondent.
Eversheds Sutherland comparison: Freezing injunction does not act as civil law attachment. Respondent can still use assets for ordinary living expenses.
Third Party Debt Order - CPR Part 72 - equivalent to Order 21 Rule 46A:
Creditor obtains order directing third party (e.g. bank holding debtor's money) to pay to creditor.
Case Law:
Next Generation Holdings v Finch EWHC 927 (Ch): Applicant who allows respondent to freezing order to sell property and pay proceeds into solicitor's client account to execute via third party debt order carries risk that solicitor's lien for unpaid invoices pre-existing freezing order takes priority. Freezing order does not defeat prior lien.[2024]
Taylor v Van Dutch Marine Holding EWHC 636 (Ch): Secured creditor of respondent to freezing order not required to apply to amend order to enforce security. Can enforce charged assets even if caught by freezing order, if not aiding disposal by defendant.[2017]
Luani v Nuku TOLC 9 - Attachment of Earnings: Tonga Supreme Court - application for attachment of earnings of Legislative Assembly member. Court held under Sec 5(2)(b) Supreme Court Act + CPR Order 27, attachment of earnings is appropriate enforcement where debtor has regular salary.[2020]
