The guarantee is for "amount in default" under additional credit facility. MLI claims from NCGTC, NCGTC pays and then recovers.
2. Legal Character under IBC & SARFAESI
ECLGS is Financial Debt under Sec 5(8) IBC. Even though guarantee-backed, it is not government debt - liability of borrower remains. Banks treat it as separate WCTL but clubbed for NPA.
3. Case Laws - Where ECLGS Became Litigious
Most litigation is in NCLT under Sec 7 IBC, around 3 issues: (a) Misappropriation / Evergreening, (b) NPA date and Sec 10A bar, (c) Assignment.
A. Misappropriation / Evergreening
1. Indounique Flame Ltd. - NCLT Mumbai Bench-IV CP (IB) No. 635/MB-IV/2023
Facts: ECLGS sanctioned vide letter dated 07.12.2020 under ECLGS. Corporate debtor argued bank misappropriated ECLGS facility.
Tribunal noted pleading:
"The Petitioner granted the ECLGS facility provided by the Govt. and illegally utilized the same towards its own dues instead of business purpose."
"ECLGS facility misappropriated"
Tribunal held that if ECLGS was used to adjust existing dues and account still overdrawn on 30.09.2020, the NPA would have occurred on 29.12.2020 which falls under Sec 10A suspension period (25.03.2020 to 24.03.2021). Petition dismissed as barred.
Principle: ECLGS cannot be used to evergreen and shift Sec 10A date.
2. Gstaad Hotels Pvt Ltd. (JW Marriott Bengaluru) vs Piramal Enterprises - Karnataka High Court WA No.478/2024, judgment 19 May 2025
Borrower availed Rs.450 cr term loan + Rs.50 cr revolver + ECLGS 2.0 and 3.0 during COVID. Borrower claimed account never NPA till 2020.
High Court examined:
"The evergreening by Respondent Piramal using to an extent of Rs.139 crores out of Rs.163 Crores disbursed under the Emergency Credit Line Guarantee Scheme is in contravention"
Writ appeal dismissed. HC upheld NCLT admission, rejected plea that borrower had no knowledge of assignment of debt. Important precedent that disbursement of ECLGS 2.0/3.0 to regularize an already stressed hospitality account = evergreening in contravention of scheme intent.
B. Clubbing & NPA Classification
3. We Two Engineering Pvt Ltd - NCLT Chennai Division Bench-II (2025) ibclaw.in 2298 NCLT
"had availed multiple credit facilities from the Bank since 2017, including OD facilities, CCOL, WCTLs, BGs, Term Loans, FITL and ECLGS, aggregating to more than Rs.23.39 crores."
Held: Default in any one facility leads to classification of entire account as NPA; ECLGS does not enjoy separate NPA status.
4. Sol Infotech Pvt Ltd - C.P.(IB) No. 290/MB/2023, NCLT Mumbai 09.01.2024
"The date of default in respect of Loan & ECLGS facility is stated to be 15.10.2022."
Tribunal treated ECLGS as part of same default bundle.
5. NCLT New Delhi Bench IB No. 718/ND/2022
"provided liquidity support 'Guaranteed Emergency Credit Line' under ECLGS 2.0 (GECL 2) vide letter No. 0084/52/S-24 dated 31.12.2020"
Court held GECL 2 is additional facility, not restructuring; repayment schedule of original loan does not change.
6. CP(IB) 989/MB/C-III/2023 NCLT Mumbai
"the interest payable on the ECLGS Facility from 31.10.2021. Therefore, the account of the Corporate Debtor turned NPA after 90 days, i.e. on 28.01.2022."
Clarifies: Non-payment of ECLGS interest triggers 90-day NPA rule like any term loan. ECLGS benefit does not pause prudential norms.
Department itself notes:
"Department of Financial Services had introduced ECLGS with an aim to provide 100% Guarantee coverage to member lending institutions"
4. Practical Oversight Takeaways for Banks / Borrowers
- Purpose Test: NCGTC guidelines require utilization for working capital / business purpose. If bank adjusts against old dues, guarantee claim fails - fraud.
- No Sec 10A circumvention: Many Sec 7 petitions 2022-23 failed because banks gave ECLGS in Sept-Dec 2020 to push NPA beyond 24.03.2021. NCLT looks through to original irregularity date (30.09.2020 in Indounique case).
- SMA-0/1 eligible only: Account must be regular, not overdue at cut-off. If account was SMA-2 at cut-off, ECLGS void.
- Guarantee invoked only after SARFAESI/IBC recovery efforts exhausted. NCGTC pays MLIs, but borrower liability continues.
If you are defending / filing: focus on (a) Bank statement trail of ECLGS disbursement - where money went, (b) ECLGS sanction letter purpose clause, (c) NPA date linkage to ECLGS interest.
