Emergency Cash Assistance Through Card Network .

1. Two Models Under Same Name

A. Emergency Cardholder Assistance - B2C:
What Visa / Mastercard run as Global Customer Assistance Services (GCAS) / Global Service

  • Emergency Cash Disbursement (ECD/ECAD): Up to USD $5,000 cash at a participating bank location within 2 hours, if your card is lost/stolen abroad. Subject to available credit limit and account in good standing.
  • Emergency Card Replacement (ECR): Replacement card within 24-72 hours.

This is not a loan from Visa. Visa is only a facilitator. Issuer (HDFC, ICICI, SBI) approves and bears risk. Visa】 rulebook says: "It is sole responsibility of issuer to ensure program complies with all applicable laws."

Contact: Visa GCAS +1-303-967-1096, Mastercard +1-636-722-7111 - 24/7

B. Emergency Disbursement Program - G2C / B2C:
Government, NGO, or employer issues prepaid emergency cards to distribute relief.

Example architectures:

  • Oxfam + Visa + UnionBank + i2c - Philippines EPS Project after Super Typhoon Haiyan 2013: 2700 prepaid Visa cards for food/shelter. Tested as Electronic Prepaid Solution . Later evolved to B-READY anticipatory cash - 1,700 pesos per family before Typhoon Ursula
  • Visa Direct + Visa Government Prepaid for B-READY: Single point of access to push funds to billions of endpoints
  • Visa Digital Enablement Lite App: Developed for US federal/state agencies to streamline disaster disbursements

Terms: No preauthorized transfers, can be used at any Visa/ Mastercard ATM, CIRUS network

2. Legal Framework - India

RBI Master Direction - Credit Card and Debit Card Issuance 2022: Cash advance is allowed as sub-limit (typically 20-40% of total limit) within total credit limit. Fee 2.5-3.5% + GST + interest from Day 1, no grace period . RBI mandates transparent disclosure .

RBI Digital Lending Directions 2025: If emergency cash is via BNPL / embedded lending on card network, must follow direct disbursement between RE and borrower, no pool account, KFS with APR, 1-day cooling off.

Payment and Settlement Systems Act, 2007: Card network is System Provider, needs RBI authorization.

Consumer Protection: Cardholder is liable for cost of any emergency services received . Issuer cannot deny ECD if credit available and GCAS approved, else deficiency of service under Consumer Protection Act.

3. Case Laws & Enforcement - Where It Goes Wrong

Category A: Fraud on Emergency Disbursement Cards

1. US Pandemic Unemployment Assistance (PUA) Prepaid Card Fraud 2020-24:
Visa documented that once a prepaid card account is established using stolen identity, fraudster makes purchase then files fraudulent "unauthorized transaction" claim . GAO report: DOJ charged 3,096 defendants for pandemic-relief fraud as of Dec 2024, 19 different programs . Prepaid debit cards issued by states paved way for fraud .
Lesson: Emergency card programs must have CIP + ID verification before funding, not after.

2. Allahabad High Court - Aadhaar Ration Fraud - 3 Aadhaars for 697 Cards:
Fair Price Shop dealer used 3 Aadhaar numbers to withdraw ration for 697 cardholders. Enquiry flagged irregularities across 43 districts since Aug 2018 . Licence cancellation upheld. FIR under IT Act. Principle applies to emergency cash cards - use of same KYC for multiple cards = systemic fraud, dealer liable.

3. Madras High Court - Cyclone Michaung Flood Relief - Justice Krishnan Ramasamy:
Court observed cash disbursement through cooperative societies leads to misappropriation, advised bank transfer as best method . This judgment is cited to push DBT via card networks instead of cash.

Category B: Cash Advance / Cash-Out Disputes

4. Credit Card Cash-Out Lending is Not Private Lending - China Court principle followed in India:
Court held credit card as voucher given by bank to specific cardholder for overdraft consumption, only for shopping at special merchants, does not have function as cash for private lending . If you do POS cash-out via merchant (e.g., Amazon Gift Cards case - PayU vs N Nirmal Chander 4 May 2023, Rs 1.5L transaction), it's violation of Discover/ Visa network rules - "You may not accept card in exchange for advancing cash unless agreed in writing" .

5. Karnataka High Court - ICICI Bank vs Digital Arrest Victim - May 2025:
Woman claimed she took Rs 50L loan under digital arrest. Court dismissed, held "Every disputed transaction tomorrow can be said to be product of digital arrest, borrower would get away". Case under Section 25 Payment and Settlement Systems Act. Establishes burden of proof for emergency cash claim fraud is on claimant.

6. Supreme Court of India - Kisan Credit Card Fraud PIL - Chandra Shekhar Mani:
Plea for pan-India enquiry into KCC frauds with bank officials connivance rejected, saying probe not possible based on general allegations, except 2 incidents . Principle: Alleging fraud in emergency credit card system needs specific evidence, not omnibus allegations.

Category C: Network Liability

7. Visa GCAS Terms Litigation - US:
Courts have consistently held Visa's GCAS provides assistance only, not insurance. Cardholder responsible for cost. Emergency assistance not liable for availability, use, cost, or results . So if emergency cash is delayed, claim lies against issuer, not network.

4. Compliance Checklist for Building Emergency Cash Assistance on Card Network in India

  1. Product Design: Is it credit (cash advance sub-limit) or prepaid (government aid)? If credit, cap at 20-40% limit, disclose fee + APR + GST upfront.
  2. GCAS Integration: Sign up for Visa GCAS / Mastercard Global Service, keep lost/stolen reporting SLA 30 mins block
  3. Reconciliation: Real-time reconciliation to avoid Synapse-type shortfall ($65-96M shortfall in 2024)
  4. Fraud Controls: Aadhaar eKYC + liveness + device binding before funding prepaid emergency card. No bulk funding to same mobile/ID.
    1. Reporting: Report to CICs within 7 days, to RBI CRILC for large credits.
