Credit Transfer Notification Obligations - Detailed Explanation with Case Laws

Credit Transfer is a push payment - payer instructs bank to credit payee. Includes NEFT, RTGS, IMPS, UPI, Domestic Money Transfer. Notification Obligation is two-way: Bank to Customer, and Customer to Bank.

Governed by:

  • Payment and Settlement Systems Act, 2007
  • RBI Master Direction on Customer Protection - Unauthorised Electronic Banking Transactions - Circular dated July 6, 2017 updated Aug 2024 / 2027 draft
  • RBI Circular on Domestic Money Transfer 2024
  • RBI Guidelines - Banks have to put system to convey credit decision to borrowers

1. Bank's Obligation to Notify Customer

A. On Execution of Credit Transfer:

  • Immediate SMS/email alert with: Reference No, amount, beneficiary name, charges.
  • As per RBI Master Direction on Credit Information Reporting 2025: CICs will have to send alerts through SMS/email when CIR is accessed - same principle extended to credit transfers.
  • Failure = deficiency. Kerala HC and Bombay HC have held bank liable if no proof of alert.

B. On Failed / Returned Credit Transfer:
If transfer to closed / incorrect account, bank must:

  • Notify payer within 2 hours (IMPS/UPI) and reverse within T+1
  • Keep record of beneficiary name verification - Under revised DMT framework, remitting bank must obtain and keep record of beneficiary's name and address for cash payout

C. On Receiving Credit Transfer (Beneficiary Bank):
New litigation: HC issues notice to RBI, NPCI over recipient-side e-payment control - Petitioner sought mandatory Accept/Decline option before incoming payment is credited. This is to prevent fraudsters dumping money then claiming. RBI examining - like UK's Confirmation of Payee.

D. On Credit Decision:
RBI asked banks to put in place timeline for credit decisions to eliminate inordinate delays in conveying credit decisions to borrowers. System must be in place within 30 days. Non-notification = unfair practice.

2. Customer's Obligation to Notify Bank

This determines liability in unauthorized credit transfer.

RBI Customer Protection Framework:

  • Zero Liability: If customer notifies bank within 3 working days of receiving communication from bank regarding unauthorized transaction, and breach is third-party (neither bank nor customer at fault).
  • Limited Liability: If notifies within 4-7 working days - max Rs 5,000 to 25,000 depending on account type.
  • Shadow Reversal: On being notified by customer, bank shall credit (shadow reversal) amount involved within 10 working days. For credit card fraud, 5 calendar days.

Burden of Proof: Allahabad HC tells Banks: Burden of Proof is yours in Consumers Unauthorized Transactions - Court examined Clause 12 of 2017 Circular - Bank must prove customer negligence, not customer to prove innocence.

3. Leading Case Laws

1. Supreme Court - Bank Bound To Follow Customer's Instruction - Canara Bank vs Archean Industries (2024-25) - Livelaw

Bank cannot unilaterally divert funds contrary to mandate.

Facts: Customer instructed Canara Bank to remit USD 100,000 to specific beneficiary. Bank erroneously remitted to third party. Madras HC directed indemnify, Supreme Court bench Justices JB Pardiwala and R Mahadevan dismissed bank's appeal, held bank liable for wrongful remittance. Principle: Notification obligation includes obtaining fresh mandate before altering credit transfer destination.

2. Supreme Court - SBI Liable to Refund Amount Reported Within 24 Hours (2024)

Banks liable for unauthorised transactions

Customer reported fraudulent electronic transaction within 24 hours. SBI argued customer shared OTP. Supreme Court affirmed HC: "We also take notice that within 24 hours customer brought it to notice of Bank" - zero liability applies. Bank ordered to refund with interest. SBI vs Rajesh Agarwal principle extended to credit transfers.

3. Kerala High Court - SBI To Refund Rs 3.73 Lakh to Cybercrime Victim

Petitioner relied on Master Circular clause 6(ii) - third party breach, notified within 3 working days - zero liability. Court held bank did not prove negligence by customer, directed refund. Burden on bank to prove customer shared password / OTP.

4. Bombay HC - Jaiprakash vs Bank (Zero Liability for Third-Party Breach)

Division Bench Justices Girish Kulkarni and Firdosh Pooniwalla referenced RBI Circular July 2017 - held customers hold zero liability for unauthorized transactions resulting from third-party breaches, provided they inform bank within specified timeframe.

5. Loan Assignment Case - Notification Obligation of Transferor Bank

Court: Bank loan assignment valid despite no prior notice as law requires only intimation to borrowers - Under Master Circular dated 24.09.2021 updated 05.12.2022, lenders may transfer stressed loans including NPAs or SMAs. RBI circular operation itself serves as constructive notice to borrowers regarding timely payment obligations to avoid SMA classification. Assignment complied even if individual notice not given before classification. However, HC recalled compromise order where assignment to ineligible transferee violated RBI Directives 2021 - assignment to Savannah not recognized transferee, unlawful. Notification to borrower after assignment mandatory.

6. Rs 20 Lakh Mistaken Transfer Case - Financial Express

Banks directed to refund Rs 20 lakh that remained blocked following mistaken transfer. Court emphasized importance of notifying both banks when money transferred to closed or incorrect account and preserving written records. Failure to notify beneficiary bank leads to liability.

4. What is Defective Notification?

  • Bank fails to alert: Customer does not know debit, loses 3-day zero liability window - Bank liable for full amount.
  • Customer fails to notify: Loses zero liability, shifts to limited / full liability.
  • Bank fails to notify beneficiary of fraud credit: Under new proposal, recipient bank must give Accept/Decline - non-compliance = bank liable.
  • Assignment of loan without intimation: Under SARFAESI Sec 13 + RBI guidelines, borrower must be notified of new creditor, else recovery action invalid.

5. Drafting Checklist for Bank SOP

  1. Real-time SMS/email with UTR/IMPS Ref + Beneficiary name match (Name matching per RBI 2024 DMT)
  2. Auto shadow reversal workflow within 10 days of customer notification
  3. Proof of delivery - log of SMS gateway, not just internal core entry
  4. For credit transfers > Rs 2 lakh - call-back verification and notification
  5. For loan assignment - registered letter + email within 3 days of transfer
