Conflict Between Deposit Stability Assumptions And Customer Behavior .

This is the most common ground for quashing tax demands, bank recovery demands, and contractual liquidated damages. Called "Demand vs Documentation Mismatch".

It arises when:

Department / Lender raises a demand alleging non-fulfilment of a condition (e.g., non-payment of tax, non-existence of supplier, suppression, failure to submit stock statement), but the taxpayer / borrower HAS provided documentation that satisfies the condition, or the demand itself does not state HOW the condition was violated.

Courts consistently hold: "Yes" is not enough, you must show "How".

In GST adjudication, a conclusion without the method, evidence and reasoning supporting it is legally vulnerable. A demand must not merely state that tax is payable. It must demonstrate how the liability arose.

1. The Core Legal Principle

Under CGST Act Sec 75(7) and general principles of natural justice:

  1. Demand Cannot Travel Beyond Show Cause Notice: What you allege in SCN is the boundary. Final order cannot add new grounds, new amount, new calculation.

A confirmation that increases the demand beyond the notice or relies on unarticulated grounds is procedurally infirm, and an order that is unreasoned and demands more than the notice cannot be sustained

Documentation Shifts Burden of Proof: Once taxpayer provides invoices, e-way bills, e-invoices, payment proof, transport proof, stock statements - burden shifts to Revenue to disprove with positive evidence, not just suspicion.

Reasoned Order Mandatory: "Reply not satisfactory" is NOT a reason.

GST Demand Set Aside as "Reply Not Satisfactory" Is Not a Reasoned Order

2. Four Types of Conflict

Type A: Condition Demanded vs Condition Documented
Example: GST Dept demands proof of movement of goods under Sec 129/130. Taxpayer provides e-invoice + delivery challan + transporter ID. Dept still demands tax for missing e-way bill.

Type B: Value Mismatch
Dept alleges bogus purchases Rs 10 Cr based on supplier being non-existent on portal. Taxpayer provides bank payment proof, GSTR-2A, goods receipt, stock register.

Type C: Procedural Lapse vs Substantive Compliance
Demand raised because ASMT-10 reply filed manually, not on portal. Or DRC-01A not issued before DRC-01.

Type D: Oral Statement vs Documentary Evidence
Demand based solely on third-party statement or Form 26AS without corroborating invoices.

3. Landmark Case Laws - India

A. Foundation - Demand Beyond SCN is Void

1. Madras High Court - Nanjappan Senthilkumar Proprietor of M/s Bhavani Agro Services vs DCCTO, Gobi - 2024 (6) TMI 1081

Held demand order cannot exceed amount or grounds in SCN. If SCN says demand Rs 10 lakhs for ITC mismatch, final order cannot confirm Rs 25 lakhs for suppression. Must issue fresh SCN.

2. Allahabad HC - M/s Pavan Traders vs State of UP - 2025 (7) TMI 331

A demand order passed under Section 73 cannot sustain if it goes beyond show cause notice

Court remanded matter for fresh hearing.

3. CESTAT - Demand Order Cannot Travel Beyond Scope of SCN

SCN was for disallowance of credit for violating Rule 9 of CENVAT Rules. Commissioner denied credit on different ground - correlation between input and output service. Tribunal:

Impugned order travelled beyond scope of show-cause notice... impugned order is not legally sustainable

B. Documentation Provided vs Demand of Bogus Firm

4. GSTAT Prayagraj - GST Demand Can't Rest on Bogus Firm Allegation Without Proof of Tax Evasion - 2026

Dept alleged inward supplies from bogus firm. Taxpayer provided tax invoices, e-way bills, transport receipts, bank payment proof.

Tribunal:

GST demands alleging bogus inward supplies require proof that supplier firm was non-existent or that tax evasion occurred. In absence of evidence disproving those facts or establishing tax evasion, allegation of bogus or non-existent firm could not sustain demand

Revenue appeal failed.

Same principle in Madras HC - Rs 9229 Crore ITC Case (2026)

Assessee argued mere intimation to dept about suppliers. Court:

Mere intimation to GST department does not shield wrongful ITC claims. Assessee failed to prove genuineness - Demand + Interest + Penalty valid

So documentation must be genuine, not just paper.

C. E-Way Bill vs E-Invoice Conflict

5. GSTAT Prayagraj - Missing E-Way Bill Alone Can't Justify Demand Without Evasion Intent

Motorcycle dealer had genuine e-invoice, but e-way bill missing for Nov 2021 transaction.

Held: Under pre-2022 Sec 129, if consignment supported by genuine e-invoice and no evidence of intent to evade, demand of Rs 1,77,248 not sustainable.

Principle: Documentation of substance (e-invoice + payment) outweighs procedural document (e-way bill) if no evasion intent.

D. Demand Based on Oral Statement Alone - Not Sustainable

6. CESTAT Delhi - Service Tax Demand Based Solely on Form 26AS / Oral Statement Unsustainable

Demand cannot be raised solely based on oral statement of witness without further evidence... Tribunal held tax demand based solely on oral statements, without corroborative evidence and without conducting examination in chief and cross examination, is unsustainable

If Dept relies on supplier's statement that "I didn't supply", must allow cross-examination and produce corroboration.

E. Failure to Consider Reply

7. Orissa HC - GST Demand Without Considering ASMT-10 Reply Is Without Jurisdiction

Proceedings under Sec 73 initiated without considering reply filed under Sec 61 scrutiny.

Court quashed order - natural justice requires proper officer to consider representation under Sec 74(9) read with Rule 142(4). Manually filed reply acknowledged at personal hearing cannot be disregarded solely because unavailable online.

8. Punjab & Haryana HC - Reply Not Satisfactory Is Not Reasoned Order

Adjudicating authority cannot reject taxpayer's response merely by stating explanation was not satisfactory. Must deal with each document produced.

F. Foundation of Notice

9. Gujarat HC - Arcelormittal Nippon Steel India Ltd vs Assistant Commissioner - 2021 (12) TMI 227 & SC - SC Quashes GST Demand for Lack of Specific Suppression Allegations (2026)

Since notice forms foundation of proceeding, order based on unclear or incomplete notice cannot be sustained merely because personal hearing was later provided. A GST demand invoking extended limitation cannot be sustained solely through general allegations of fraud, wilful misstatement or suppression without supporting facts in notice itself.

Department permitted to file fresh notice with foundational facts before Feb 2027.

4. How to Use This in Practice - Checklist to Quash Demand

If you have received demand but you have documentation, file reply on these 5 grounds:

Ground 1 - Sec 75(7) Violation: "Demand in DRC-07 exceeds/ is different from grounds in DRC-01. List difference."

Ground 2 - No How: Dept says "ITC inadmissible" but does not show HOW conditions of Sec 16(2) violated. Cite: "YES is nothing without HOW".

Ground 3 - Documentary Evidence Ignored: Enclose: Invoice, E-way, E-invoice, Transporter GR, Weighment slip, Stock register, Bank statement showing payment, GSTR-2B. Say burden shifted.

Ground 4 - No Corroboration: If based on third-party statement / data analytics / 2A vs 3B difference without verification, demand corroborative proof and cross-examination.

Ground 5 - Procedural Failure: No DRC-01A, No ASMT-10 consideration, No personal hearing notice.

In most recent orders, Courts are setting aside demand and saying: "Revenue free to initiate fresh proceedings in accordance with law" - which gives you 3-6 months breathing time and chance to settle under amnesty.
