OREGON ADMINISTRATIVE RULES (OAR) — CHAPTER 644

Department of Agriculture — Oregon Sheep Commission

These rules govern the operation, assessments, public records, and commission governance of the Oregon Sheep Commission.

DIVISION 1 — Procedural Rules

644‑001‑0000 Procedure for Notice of Intended Rulemaking

Before adopting, amending, or repealing a permanent rule, the Commission must provide notice.

Notice must be provided:

At least 21 days before the rule’s effective date.

To persons on the Commission’s mailing list at least 28 days prior.

To legislators at least 49 days prior.

To newspapers and interested parties in primary production regions.

DIVISION 5 — Screening and Selection Procedures for Personal Service Contracts

644‑005‑0005 Purpose: Rules for how the Commission hires personal service contractors.

644‑005‑0010 Basic Policy: Promote fair and competitive selection.

644‑005‑0015 Definitions: Terms for consistent application (e.g., “contractor,” “proposal”).

644‑005‑0020 Procurement Method: Outlines methods for hiring contractors.

644‑005‑0025 Mailing List: Maintenance and distribution of parties to receive Requests for Proposals (RFPs).

644‑005‑0030 Competitive Negotiation Procedures: Evaluation and negotiation process for contracts.

DIVISION 10 — Reporting and Payment of Assessments

644‑010‑0005 Definitions:

Person: Individual, corporation, partnership, or other legal entity.

Commission: Oregon Sheep Commission.

Handler: Buyer or processor of live sheep.

Producer: Raises, breeds, or sells sheep.

Sheep: All animals of the ovine species.

644‑010‑0010 Assessments:

Handlers deduct $0.50 per sheep sold and remit quarterly.

Producers processing their own sheep must remit $0.50 per head quarterly.

Producers selling to out-of-state handlers must remit unless another party agrees to remit.

Applies to sheep fed or grazed in Oregon at least 30 days in the past year.

644‑010‑0015 Reports and Payment:

Quarterly reports must be filed on specified forms.

Due dates:

Jan–Mar: April 10

Apr–Jun: July 10

Jul–Sep: October 10

Oct–Dec: January 10

Receipts must include: collector’s name/address, date of sale, buyer/seller info, number of sheep, and total assessment.

644‑010‑0020 Penalties:

Late payments incur 10% penalty plus 1.5% interest per month.

Waivers possible for good cause.

644‑010‑0025 Effective Dates:

Specifies when assessments take effect for new or amended rules.

DIVISION 20 — Public Records Requests

Establishes procedures for requesting records from the Commission.

Requests must be in writing and processed according to set procedures.

DIVISION 30 — Commission Structure

644‑030‑0010 Commissioners:

The Commission has 8 members appointed by the Director of Agriculture.

Terms are 4 years.

Rules set qualifications, term limits, and removal procedures.

DIVISION 40 — Compensation and Expenses

644‑040‑0010 Per Diem and Expenses:

Commissioners not full-time public employees may receive compensation for official duties.

Rate: up to $30 per day.

Claims must be submitted within 30 days of the end of the quarter.

Reimbursement for travel and other allowable expenses is provided.
