Ohio Administrative Code Title 152 - Ohio Building Authority
Ohio Administrative Code – Title 152: Ohio Building Authority
Title 152 of the Ohio Administrative Code (OAC) contains rules established by the Ohio Building Authority (OBA). The OBA was historically responsible for overseeing the construction, maintenance, and leasing of state-owned office buildings and facilities.
⚠️ Note: In 2011, the responsibilities of the Ohio Building Authority were transferred to the Ohio Department of Administrative Services (DAS) under House Bill 153, and the Ohio Building Authority was dissolved. However, Title 152 remains in the code for reference to older contracts and provisions still in effect.
Overview of Title 152 Contents
Although much of Title 152 is now outdated or superseded, here’s a summary of what it includes:
1. Definitions and Authority
Establishes terms used in contracts, leases, and facility management.
Clarifies the authority the OBA had to enter into lease agreements, construction contracts, and project financing.
2. Lease and Use of Space
Sets rules for:
Leasing space to state agencies in buildings owned or operated by the OBA.
Conditions under which non-state tenants could lease space.
Rent calculation and service charges.
3. Construction and Renovation Projects
Procedures for:
Planning and design of new facilities.
Procurement of construction services.
Use of competitive bidding or design-build processes.
Requirements for bonding, insurance, and contractor qualifications.
4. Bonds and Financing
Authority to issue revenue bonds for construction and renovation of public buildings.
Rules for debt service payments and lease revenue allocations.
5. Maintenance and Operations
Establishes responsibility for:
Facility maintenance standards
Energy conservation
Building safety and security
6. Asset Transfer and Agency Rules
Provisions for transferring building assets to other state agencies, especially after OBA’s dissolution.
Rules on how existing contracts and leases would be administered post-transition.
Current Administration
Since the OBA's functions are now handled by the Ohio Department of Administrative Services (DAS), most construction, leasing, and facility oversight falls under OAC Title 123, particularly:
123:1 – General DAS rules
123:5 – Division of Purchasing
123:15 – Office of Properties and Facilities
