📂 Structure of Title 16

According to the NC Administrative Code and Justia, Title 16 comprises the following chapters 

Chapter 01 – Departmental Rules (Subchapters A–C): Covers general provisions and procedures for the Department of Public Instruction.

Chapter 02 – Public Instruction: Repealed (Subchapters A–H).

Chapter 03 – Controller’s Office: Repealed.

Chapter 04 – Community College System: Transferred to 23 NCAC 02 (now maintained in that title) 

Chapter 05 – Controller’s Office: Repealed.

Chapter 06 – Elementary & Secondary Education (Subchapters A–K): Active and comprehensive; covers everything from licensure, standards, student services, to educator conduct 

Chapter 07 – NC Standards Board for Public School Administration: Defines rules and procedures for administrative standards 

🔍 Chapter 06 Highlights (Elementary & Secondary)

Much of the active regulatory framework resides in Chapter 06, including:

Licensing rules and educator fees (e.g., 16 NCAC 06C .0371) 

Code of Professional Conduct for educators, including license revocation, disciplinary investigation, misconduct reporting requirements, child-abuse reporting, etc. (e.g., subchapter 06C .0601–.0608)

Standards & accountability subchapters: Teacher evaluation, performance appraisal (.0500s), special education services, support services (.0400s and .0500s)

Instructional programs: Textbook adoption, curriculum standards, LEP services (.0100s–.0300s) .

Student services: Attendance, driver training, athletics, discipline provisions (Subchapters E, I, J) 

Federal program compliance: Special education, nutrition, homeless student support rules aligning with federal law (Subchapter 06H) 

📝 Summary

Title 16 is primarily active in Chapters 1, 6, and 7.

Chapter 06 forms the core rule set for K–12 education, including educator licensure, conduct, curriculum, special ed, support services, accountability, and student regulations.

Chapters 2, 3, and 5 are now repealed. Chapter 04 has moved into 23 NCAC 02.
