Minnesota Constitution – Article V: Executive Department

This article outlines the structure, roles, and election of executive officers in the state of Minnesota.

Section 1. Executive officers

The executive department consists of:

Governor

Lieutenant Governor

Secretary of State

Auditor

Attorney General

These officers are elected by the people.

Section 2. Term and election

These executive officers are elected every four years.

Elections are held at the same time and in the same manner as members of the legislature.

The governor and lieutenant governor must be elected jointly by a single vote (i.e., a ticket).

Section 3. Returns and canvass

The election returns are sealed and delivered to the president of the Senate.

A joint convention of both legislative houses canvasses the returns and declares the results.

Section 4. Powers and duties

The Governor is the chief executive of the state.

The Governor ensures laws are faithfully executed and can require reports from any executive officer.

Section 5. Succession

If the governor dies, resigns, is removed, or is unable to serve, the lieutenant governor becomes governor.
