Michigan Constitution – Article VIII: EDUCATION

§ 1 Public education; free public elementary and secondary schools; discrimination.

Religion, morality and knowledge being necessary to good government and the happiness of mankind, schools and the means of education shall forever be encouraged. The legislature shall maintain and support a system of free public elementary and secondary schools as defined by law. Every school district shall provide for the education of its pupils without discrimination as to religion, creed, race, color or national origin.

§ 2 Higher education institutions; appropriations; accounting; limitations.

The legislature shall appropriate moneys to maintain the University of Michigan, Michigan State University, Wayne State University, and other institutions of higher education as established by law. These institutions shall be subject to the general supervision of their governing boards, which shall have general supervision of the institution and the control and direction of all expenditures. The governing boards shall make an annual accounting of all income and expenditures.

§ 3 State board of education; members; nomination; election; term.

There shall be a state board of education which shall be elected as provided by law. The board shall advise the legislature as to the financial requirements and recommend priorities of the educational system of the state as provided by law.

§ 4 Superintendent of public instruction; appointment; powers and duties.

The state board of education shall appoint a superintendent of public instruction whose term of office shall be determined by the board. He shall be the principal executive officer of the state department of education and shall execute the board's policies. He shall be ex officio a nonvoting member of the board.

§ 5 Intermediate school districts; boards; duties.

Intermediate school districts may be established by law, with powers and duties provided by the legislature. Their boards may be elected or appointed as provided by law.

§ 6 Higher education institutions; governing boards.

The University of Michigan, Michigan State University, and Wayne State University shall each be governed by an elected board:

UM: Board of Regents

MSU: Board of Trustees

WSU: Board of Governors
Each board consists of eight members elected for eight-year terms, as provided by law.

Other institutions of higher education shall be governed by boards as provided by law.

§ 7 Religion and education.

No public monies or property shall be appropriated or paid for the support of any religious sect or denomination or for any private, denominational, or other nonpublic elementary or secondary school.

§ 8 Aid to nonpublic schools; prohibited.

No public funds shall be appropriated to aid or maintain any private, denominational, or other nonpublic school, nor shall attendance at such schools be used as fulfillment of compulsory education requirements.
