ARTICLE 1
GENERAL PROVISIONS

Authority and Purpose
These regulations are adopted under the authority granted by Kansas statutes to the Livestock Brand Commissioner. They establish procedures for the registration, inspection, transfer, and enforcement of livestock brands in the state of Kansas.

Definitions
For purposes of these regulations:
Brand: Any symbol, design, or mark registered to identify ownership of livestock.
Commissioner: The Kansas Livestock Brand Commissioner or the Commissioner’s designee.
Livestock: Cattle, horses, mules, sheep, or other animals designated by statute.
Owner: Any person, partnership, or corporation holding legal title to livestock.
Inspection: Official examination of livestock for brand verification.
ARTICLE 2
BRAND REGISTRATION

Application for Brand Registration
Any person desiring to register a brand must submit a completed application to the Commissioner, including:
A clear description or drawing of the brand.
Identification of placement on the animal.
The owner’s full name and address.

Approval and Issuance
Upon approval of a brand application, the Commissioner will issue a certificate of registration. A brand cannot be used until registration is complete.

Change or Cancellation of Brand
An owner may request modification or cancellation of a registered brand. The Commissioner may approve such requests after verifying that the change does not conflict with existing registered brands.

BRAND INSPECTION

Inspection Requirement
All livestock sold, transported, or delivered must be inspected for ownership verification unless exempted by law.

The Commissioner shall maintain inspection records including:
Brand verified
Date and location of inspection
Owner and inspector information
ARTICLE 4
ENFORCEMENT AND PENALTIES

Unauthorized Branding
It is unlawful to brand livestock with a brand not registered to the owner. Violations may result in fines, seizure of livestock, or other penalties as prescribed by law.

Misrepresentation
Falsifying brand information or obstructing an inspection constitutes a violation and may lead to administrative action or criminal penalties.

The Commissioner may establish fees for:
Brand registration
Transfer of ownership
Brand inspection

Records Retention
All records maintained by the Commissioner shall be retained and made available in accordance with state law and administrative procedures.
ARTICLE 6
EFFECTIVE DATE AND AMENDMENTS
K.A.R. 8-6-1
These regulations shall become effective upon publication and may be amended, repealed, or replaced by the Commissioner in accordance with the Kansas Administrative Procedure Act.
