In Jordan, judicial review is a fundamental aspect of the constitutional framework, ensuring that laws and regulations align with the provisions of the Constitution. The Constitutional Court, established in 2012, serves as the primary institution for overseeing the constitutionality of legislation and interpreting constitutional provisions.

🏛️ Constitutional Court of Jordan

The Constitutional Court was established following constitutional amendments in 2011 and operates under Law No. 15 of 2012 It is an independent judicial body based in the capital, Amman, and comprises at least nine members, including the president, all appointed by the King for a non-renewable six-year term  The Court's primary functions include

Oversight of Constitutionality:Reviewing the constitutionality of applicable laws and regulations

Constitutional Interpretation:Interpreting provisions of the Constitution when requested by the Council of Ministers or either House of Parliament 

Final and Binding Decisions:Issuing judgments that are final and binding on all authorities, effective immediately unless specified otherwise, and published in the Official Gazette within fifteen days 

⚖️ Judicial Review in Practice

The Constitutional Court has exercised its judicial review powers in various cases

Civil Procedure Code:In 2023, the Court rejected an appeal challenging the constitutionality of certain provisions in the Civil Procedure Code, affirming their compliance with constitutional principles 

Government Contracts:In 2019, the Court ruled that a gas deal between the National Electric Power Company and Noble Energy did not require parliamentary approval, as it was signed between two companies and not two states 

🔄 Calls for Reform

Despite its pivotal role, the Constitutional Court's jurisdiction is currently limited to cases referred by the government or Parliamen. A 2020 study by the Friedrich-Ebert-Stiftung recommended expanding the Court's jurisdiction to allow political parties, unions, civil society organizations, and individual citizens to directly file cases, thereby enhancing public trust and accessibility
