Title 230 of the Indiana Administrative Code governs the Indiana Clemency Commission, a now-defunct agency that was originally responsible for reviewing clemency petitions, including pardons, reprieves, and commutations of sentence in the state of Indiana.

Overview:

Purpose: The Clemency Commission was created to review and make recommendations to the Governor of Indiana regarding clemency applications from convicted offenders.

Scope: Its authority included reviewing cases involving:

Commutations of death sentences.

Requests for pardons.

Reprieves.

Commutations of sentences to lesser terms.

Status:

As of legislative and administrative changes in the early 2000s, the Clemency Commission's functions were transferred to the Indiana Parole Board. The relevant sections of Title 230 are now largely obsolete, and the Indiana Parole Board (Title 220) handles clemency proceedings.

Current Authority:

The Governor retains ultimate clemency power under the Indiana Constitution (Article 5, Section 17).

The Indiana Parole Board serves in an advisory capacity, reviewing applications and providing recommendations to the Governor.
