Florida Administrative Code – Title 38: Department of Labor and Employment Security (DLES)

The Department of Labor and Employment Security (DLES) under Title 38 of the Florida Administrative Code historically administered programs related to labor standards, workforce development, unemployment compensation, vocational rehabilitation, and disability services.

⚠️ Important Note:
As of the early 2000s, the DLES was abolished and its functions were transferred to other agencies, primarily the:

Department of Economic Opportunity (DEO) – now largely responsible for workforce and employment programs

Department of Education (DOE), Division of Vocational Rehabilitation

Department of Financial Services (DFS) – for workers' compensation

Agency for Persons with Disabilities (APD)

Rules governing eligibility, appeals, and employer contributions

Now under DEO (Title 73B, F.A.C.)

Workers’ Compensation

Administered by the Division of Workers' Compensation

Now under Department of Education (Title 6A-25, F.A.C.)

Labor Standards and Employment Regulation

Wage claims, child labor laws, and related issues

Functions mostly dissolved or transferred

Blind Services and Disability Determinations

These services are now under:

Department of Education – Division of Blind Services

Social Security Administration (federal level)

Current Relevance of Title 38:

Many chapters are repealed, and the title is largely obsolete.
