California Constitution – Article XXII: Architectural and Engineering Services

This article addresses the use of private-sector services for architectural and engineering work by public agencies in California.

Section 1 – Use of Private Architectural and Engineering Services

The State of California and all political subdivisions (cities, counties, districts, etc.) may contract with private entities for architectural and engineering services.

This includes planning, designing, and inspecting construction projects.

These services can be provided by private firms or individuals, not just public employees.

Section 2 – Legislative Implementation

The Legislature may enact laws to implement this article.

Any such laws must be consistent with the article’s provisions.

Purpose:
Article XXII was added to the California Constitution to ensure that government agencies can use private-sector expertise in public construction projects, increasing efficiency and flexibility.
