Alabama Constitution Section 49 - Compensation of members of legislature.

Alabama Constitution – Section 49: Compensation of Members of Legislature

Section 49 of the Alabama Constitution states:

"Senators and representatives shall receive compensation to be fixed by law, but no increase in compensation shall take effect during the term for which the members of the legislature were elected at the time such increase was passed."

Explanation:

This section deals with how members of the Alabama Legislature (i.e., senators and representatives) are paid:

Compensation Set by Law:
The amount legislators are paid is determined by state law, not the Constitution itself.

No Immediate Pay Raises:
If the legislature passes a law to increase their own pay, that increase does not take effect until the next term—meaning current members won't benefit from the raise during their existing term.

Purpose:

To prevent conflicts of interest or self-serving behavior by legislators.

Ensures that voters can hold legislators accountable before they benefit from any pay increase they approved.
