Alabama Constitution Section 227 Liability of public utilities in municipal corporations for damages to abutting property owners

Here is the text of Section 227 of the Alabama Constitution:

Section 227 – Liability of public utilities in municipal corporations for damages to abutting property owners.

Municipal and other public corporations and individuals invested with the privilege of taking or damaging private property for public use shall make just compensation for the property taken or damaged; and the legislature is authorized to provide by law the method and mode of procedure for determining such compensation in all cases not provided for in this Constitution.

Summary:

Public utilities or municipal corporations must provide just compensation when they damage or take private property—including property next to (abutting) public projects.

This protects property owners when public works (like road widening, utility installation, etc.) harm their property.

The legislature has the power to set the procedures for how this compensation is determined.

This section enforces the principle of eminent domain with fair compensation for affected property owners.
