Lian under Muslim Law
⚖️ Lian under Muslim Law
1. What is Lian?
Lian is a solemn Islamic procedure invoked in cases where a husband accuses his wife of adultery (zina) but cannot produce four male eyewitnesses to prove the charge.
It is a formal mutual imprecation (cursing) ceremony performed by the husband and wife before a Qazi (Islamic judge) or a competent authority.
Upon completion, the marriage is immediately dissolved, and the couple is permanently forbidden from remarrying each other.
2. Purpose of Lian
To protect the wife from false accusations of adultery.
To provide a clear and immediate remedy where the husband alleges infidelity but lacks evidence.
To maintain social and moral order under Islamic law.
3. Legal Framework
Lian is governed by Muslim personal law and recognized in countries with Islamic law.
In India, it is recognized as part of Muslim law but no specific codified law prescribes the procedure.
Courts may record the mutual oaths as per Islamic principles.
4. Procedure of Lian
The husband publicly accuses the wife of adultery.
Both husband and wife appear before the Qazi or court.
The husband pronounces a triple curse invoking God’s wrath upon himself if he is lying.
The wife responds with a counter triple curse invoking God’s wrath upon herself if she is lying.
This mutual imprecation is called “Lian”.
The marriage is dissolved immediately by the pronouncement.
5. Effects of Lian
The marriage between husband and wife is terminated immediately.
The parties are permanently barred from remarrying each other.
If they wish to remarry, the wife must marry another man, consummate that marriage, and then get a divorce (known as halala) before remarrying the first husband (in Sunni law).
Protects the wife from wrongful accusations without evidence.
